RESOLUTION NO. 90-46
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
FINDING OVERRIDING CONSIDERATIONS TO JUSTIFY GENERAL
PLAN AMENDMENT ON A 27 ACRE PARCEL BY GENNARO FILICE
WHEREAS, after duly noticed public hearings as required by
law,
the Planning Commission of the City of Gilroy
has
recommended that the City Council find overriding considerations
for a general plan amendment changing land use on approximately
27 acres of land at 5480 Old Monterey Highway east of Highway
101, and
WHEREAS, Notwithstanding the existence of significant
environmental effects which cannot be mitigated to less than
significant levels, the City Council of the City of Gilroy hereby
finds that the benefits of the project (specifically, truck stop
facilities accommodating the City of Gilroy's growing population
and jobs base) outweigh the environmental impacts which cannot be
completely
mitigated,
and
therefore
finds
the
adverse
environmental
effects
to be acceptable.
Mitigation
was
contemplated for each of the unavoidable impacts, but complete
mitigation of each has been found to be unfeasible due to the
following:
1. The loss of agricultural production potential could be
only partially mitigated by scaling down the proposal.
2. The impact of the potential of flooding of the project
area can only be partially mitigated through the
adopted
mitigation measures.
BE IT RESOLVED: The City Council of the City of Gilroy
finds that any significant environmental effects which cannot be

mitigated are outweighed by the beneficial effects of the project
for the citizens of Gilroy.
