RESOLUTION NO. 91 - 28
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY AUTHORIZING THE DEPARTMENT OF
PUBLIC SAFETY TO HOLD COUNTY HARMLESS REGARDING RELEASE OF CONFIDENTIAL MENTAL
HEALTH INFORMATION.
WHEREAS, the County of Santa Clara Bureau of Mental Health Services, and the
Department of Public Safety of the City of Gilroy, have established policies and
procedures for the release of confidential mental health information for the
purpose of defusing hostage or potential suicide crisis situations; and
WHEREAS, the County of Santa Clara has requested a hold harmless agreement
from the City of Gilroy covering the acts and omissions of its Department of Public
Safety in connection with the above-mentioned procedures.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of the City of Gilroy
that the City of Gilroy agrees to defend, indemnify, and hold harmless the County
of Santa Clara, its Board of Supervisorst officers, agentst and employees, from any
and all damages, claims, causes of actiont losses, liabilities, or judgments,
including attorneys' fees and costs, as a result of or arising out of the
Department of Public Safety's acts or omissions related to the disclosure of
limited confidential mental health information by the County Mental Health Bureau
to the Department of Public Safety in crisis situations where the patient presents
a serious danger of violence to himself or to foreseeable victim(s) and disclosure
is necessary in order to avert the threatened danger.
PASSED AND ADOPTED by the City Council of the City of Gilroy at a regular
meeting of said Council, held on the 20th day of May, 1991, by the following vote
of said Council:
