RESOLUTION NO. 91 - 39
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MAKING FINDINGS REGARDING CHANGES
AND }l)DIFICATIONS m THE NATIONAL ELECTRICAL CODE
WHEREAS, the City Council has heretofore adopted the latest edition of the
National Electrical Code pursuant to the authority set forth in Section 17922 of
the Health and Safety Code as the Electrical Code for the City of Gilroy; and
WHEREAS, Section 17958.5 and 17958.7 of the Health and Safety Code
authorizes the Ci ty to make changes or modifications in the codes as deemed
necessary because of local conditions, upon express findings that such
modifications or changes are needed; and
WHEREAS, certain local conditions have justified and now justify
modifications in such code, by the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy,
State of California, that it hereby finds and determines that the following
designated changes or modifications are reasonably necessary because of local
conditions set forth hereafter:
1. NATIONAL ELECTRICAL CODE

The National Electrical Code is adopted to insure a safe and
workable electrical system with minimum regulations.
a. Allowing power transformers to be installed overhead and
concealed poses an unacceptable risk to fire and investigative
personnel both during and following a fire, or a major seismic
event. The City is located in seismic zone 4. Damaged
structural members may no longer be capable to supporting the
weight of the transformer and failure could occur without
warning.
2. AMENDMENTS IMPACTING HOUSING
No impact on housing.
That a copy of this resolution be kept in the office of the Chief Building
Official for examination by interested persons.
PASSED AND ADOPTED this 1st day of July, 1991, by the following vote.:
