RESOLUTION NO. 91 - 69
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
CONDITIONALLY APPROVING THE APPLICATION OF INDUSTRIAL
TWENTY VENTURES FOR TENTATIVE SUBDIVISION MAP TM-91-03
FOR A 6-LOT INDUSTRIAL SUBDIVISION ON A 6.562 ACRE
PROPERTY ZONED M2 LOCATED AT THE NORTHWESTERLY END OF
MAYOCK ROAD.
WHEREAS, the applicant, Industrial Twenty Ventures, has made
application TM 91-03 for tentative subdivision map approval for an
industrial subdivision of 6 lots on approximately 6.562 acres at
the northwesterly end of Mayock Road; and
WHEREAS, an Environmental Impact Report to this project was
certified by the City Council on April 5, 1982; and
WHEREAS, the matter came regularly before the Planning
Commission at a duly noticed public hearing on November 7, 1991,
and after hearing and considering the evidence before it, the
Planning Commission recommended that TM 91-03 be approved with
conditions by a vote of 4-0-2; and
WHEREAS, the matter has now come regularly before the City
Council at a duly noticed public hearing on November 18, 1991, and
the City Council has heard and considered the evidence before it;
NOW, THEREFORE, BE IT RESOLVED that:
A. The City Council hereby finds that the proposed project
is consistent with the General Plan because it conforms to the land
use designation for the property on the General Plan map and is
consistent with the intent of the text of the General Plan
document.
B. The City Council hereby further finds on the basis of the
evidence before it that none of the reasons for denial of the
subdivision pursuant to Government Code Section 66474 exist in this
case.
C. Tentative subdivision map application TM 91-03 is hereby
approved SUbject to the conditions listed in the staff report
signed by the Planning Director and dated October 30, 1991. Said
conditions are attached hereto and incorporated herein by this
