RESOLUTION NO. 91-77
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING GPA 91-02, AMENDING THE
TEXT OF THE GENERAL PLAN OF THE CITY OF GILROY
TO INCLUDE SECTION 17, RURAL/URBAN LAND USE IN
THE EXISTING SOUTH COUNTY JOINT AREA PLAN AND
TO ADOPT THE RURAL/URBAN LAND USE
IMPLEMENTATION PROGRAM
WHEREAS, the city of Gilroy has submitted GPA 91-02, to
amend the text of the General Plan of the City of Gilroy to include
Section 17, Rural/Urban Land Use in the existing South County Joint
Area Plan and to adopt the Rural/Urban Land Use Implementation
Program; and
WHEREAS, the Planning commission upon giving the notice
required by law did on the 3rd day of October, 1991, conduct a duly
advertised public hearing as prescribed by law to consider GPA
91-02 and passed Resolution No. 91-21 making certain findings,
including that a Negative Declaration had been prepared pursuant
to the requirements of the California Environmental Quality Act,
and recommending that the Negative Declaration and GPA 91-02 be
approved by the City Council; and
WHEREAS, the City Council upon giving the required notice
has on the 16th day of December, 1991, conducted a duly advertised
public hearing as prescribed by law to consider GPA 91-02; and
WHEREAS, based on the evidence in the record before it,
the City Council concurs with the findings of the Planning
Commission, and further finds that
1. There is no substantial evidence before the city
Council that the proj ect may have a significant effect on the
environment; and
2. The city has properly taken all actions required by
the California Environmental Quality Act; and
3. The adoption of GPA 91-02 is in the public interest;

NOW, THEREFORE, BE IT RESOLVED THAT:
A. The Negative Declaration prepared for GPA 91-02, a
copy of which is attached hereto as Exhibit "A" and incorporated
herein by this reference, should be and hereby is approved; and
B. GPA 91-02 should be and hereby is approved, so that
section 17, Rural/Urban Land Use, attached hereto as Exhibit "B"
and incorporated herein by this reference, is included into the
existing South County Joint Area Plan, which is an addendum to the
City of Gilroy General Plan, that the Rural/Urban Land Use
Implementation Program, attached hereto as Exhibit "c" and
incorporated herein by this reference, is hereby adopted.

INITIAL STUDY:
An Initial Study of this project was undertaken and prepared for the
purpose of ascertaining whether this project might have a significant
effect on the environment. A copy of this study is on file at the City of
Gilroy Planning Department, 7351 Rosanna Street, Gilroy, CA 95020.
FINDINGS & REASONS:
On the basis of the information presented in the Initial Study, it has been
found that the above mentioned project will not have a significant effect
on the environment. The following reasons will support this finding:
The Initial Study prepared for Section #17 (Rural/Urban land Uses) and a
previous EIR prepared for the adoption of the South County Joint Area Plan
found that the project will cause no significant adverse environmental
impacts. As addressed in the Initial Study, no effects have been
identified which would be more severe under the (plan) than under existing
policies, or that would occur as a result of the adoption of the (plan),
but not under local plans. In almost all policy areas of proposed Section
#17 the plan increases the protection for the South County community and
environment by providing a more well-defined and coordinated basis for
future planning.

organizations, ani appropriate entities can make rational decisions

17.03 '!he e.xistin:J County/Cities referral process ,:for review ani c::onunent on
lani use proposals should be enhanced by including a set of mutually
agreed-upon criteria for analyzin:J lam use proposals in the
unincorporated area. '!he criteria would fcx::us the review process on
mutually-defined issues relatin:J to :rural lani use decisions, while
allowin:J for consideration of other concerns when appropriate.
17.04 '!he sane referral process should be adapted by the three jurisdictions
for review ani c::onunent on proposed major changes in city lani use
policy ani for major city-area projects or expansions. '!he review
should fcx::us on area-wide objectives, such as jobs-housin:J balance,
open space protection, am provision of infrastructure.
17.05 '!he Advisory Committee should have a process by which it will review
projects of regional significance am projects referred to it by other
agencies. '!he Advisory Canunittee' s review should provide the lead
agency, or agency havin:J decision-makin;J jurisdiction, with input
relative to the South County Joint Area Plan am issues of concem to
the South County camrnunity.
17.06 If it is detennined that a use proposed' for the unincorporated area is
needed in the South county but would be lOOre appropriately located in a
city, then the use should not be located in the unincorporated area,
but instead located in the City provicii.rq there is or could be
sufficient ani appropriately zoned lam.
17.07 '!he three jurisdictions should work together to assure that
appropriately located sites are available for larrl uses which primarily

a. consideration should be given to lan:i uses that will result in
pennanent p~tion of substantial areas of open space;
b. neW' land uses should be consistent with programs which the three
jurisdictions develop to maintain greenbelts between Morgan Hill and
San Jose, and between Morgan Hill, San Martin, am Gilroy; am
c. the three jurisdictions should further define the appropriate lam
uses for greenbelts am nethods of iIrplementation that address
conflicts between private property rights an:i public objectives.
17.10 '!he South County jurisdictions should d~elop a process to anticipate
am manage the cumulative iInpacts of lam use. '!he process should
include:
a. agreem:nt by the three jurisdictions on what are the critical
environmental am other camrnuni.ty iInpacts which are likely to have
CUI1U.1lati ve significance (e. g. grourrlwater quality, drainage,
traffic, rural visual appearance, solid waste am sewage disposal) ;
b. agreem:nt on feasible nethods for lOOl1i.torirg am evaluating changing
con:ii.tions regard:irq these iInpacts pericxtically (e.g. a summary
"state of the South County" report at two year intervals);

the review of large scale proposals.
