RESOLUTION NO. 92- 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY CONDITIONALLY APPROVING THE APPLICATION OF OBATA BROTHERS FOR A TENTATIVE SUBDIVISION MAP TM 91-04 FOR AN ELEVEN-LOT INDUSTRIAL SUBDIVISION ON PARCEL 841-15-130, CONSISTING OF APPROXIMATELY SIX ACRES ON ROSSI LANE BETWEEN MAYOCK ROAD AND SOUTHSIDE DRIVE WHEREAS, the applicant, Obata Brothers, has made application TM 91-04 for a tentative subdivision map approval for an industrial division of eleven lots on parcel 841-15-130, consisting of approximately six acres on Rossi Lane, between Mayock Road and Souths ide Drive; and WHEREAS, an Environmental Impact Report for this project was certified, and all findings required by the California Environmental Quality Act were made, by the City Council on July 19, 1982; and WHEREAS, the matter came regularly before the Planning commission at a duly noticed and advertised public hearing on January 2, 1992, and after hearing and considering the evidence before it, the Planning Commission unanimously recommended that TM 91-04 be approved with conditions; and WHEREAS, the matter has now come regularly before the City Council at a duly noticed and advertised public hearing on January 21, 1992, and the City Council has heard and considered the evidence before it; NOW, THEREFORE, BE IT RESOLVED THAT: A. The city Council hereby finds as follows: 1. The proposed project is consistent with the General Plan because it conforms to the land use designation for the property on the General Plan map and is consistent with the intent of the goals and policies of the General Plan document; RESOLUTION NO. 92 - 5 -1- -",...t . . 2. None of the reasons for denial of the sUbdivision pursuant to Government Code section 66474 exist in this case; and 3. The City has properly taken all actions required by the California Environmental Quality Act; B. Tentative Subdivision Map Application TM 91-04 should be and is hereby approved subject to all conditions listed in the staff report signed by the Director of Planning and dated December 18, 1991. Said conditions are attached hereto and incorporated herein by this reference. All proposed off-site street inprovemants on Wren Avenue shall be constructed in accordance with =ent City Standard Details, subject to the review and approval by the Depart:llent of Public Works. 2. Engineering details such as pipe sizes and locations, storm drainage design and requiranents, street light and sidewalk requirenents are subject to the review and approval by the Depart:llent of Public Works. 3. Utility lines to and adjacent to the site shall be located underground. 4. SeINer allotrrent shall be assigned to this project, and the applicant shall sign a sewer allotrrent agreenent pri= to issuance of any building permits. 5. '!he design for sewer line inprovemants within the project area shall be provided by the developer, subject to the review and approval by the Depart:llent of Public Works. 6. All hydrant locations and water main sizing shall be approved by the Gilroy Fire Depart:llent prior to the issuance of any building permits. 7. Public utility easements shall be provided for storm drain, sewer lines, and water lines, subject to the review and approval by the DepartJrent of Public Works. 8. All grading operations and soil catpaction activities shall be subject to the review and approval by the Depart:llent of Public Works. 9. All proposed retaining walls shall be constructed of masomy materials, subject to the review and <q:proval by the City Building and Public Works Departments. 10. pri= to building permit issuance, the applicant shall secure approval fran the Santa Clara Valley Water District (SCVWD) f= all right-of-way dedications and outfall structures involving the adjacent drainage channel. All outfall structures shall be subject to SCVWD and City of Gilroy Public W=ks Depart:llent approvals. 11. '!he subject parcel is currently located within a Federal Emergency Managerrent Agency (FEMA) flcxxiway. Pri= to obtaining final map <q:proval, the applicant shall secure a Letter Of Map l\nendment (Ia1A) fran FEMA. 12. If the Gilroy Unified School District and the City of Gilroy determines that the project will inpact local schools beyond the level offset by required school ilrpaction fees, the developer shall, as soon as possible, and before issuance of any building permits for the project, negotiate with the Gilroy Unified School District and the City of Gilroy and agree to furnish funds = facilities that will fully mitigate such inpacts. ..--.... .. . ~ "'-.....
