RESOLUTION NO. 92-9
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ESTABLISHING A POLICY FOR THE
PURCHASE OF USED VEHICLES
WHEREAS, it is necessary from time to time for the City
of Gilroy to purchase vehicles for the City fleet; and
WHEREAS, it is not always necessary that such vehicles
be purchased in new condition; and
WHEREAS, the City can realize significant savings for its
taxpayers by purchasing used vehicles when the situation warrants;
and
WHEREAS, the purchase of vehicles is not a contract for
a public project governed by Section 1109 of the Charter of the
City of Gilroy;
NOW, THEREFORE, BE IT RESOLVED THAT a used vehicle
purchasing policy should be and is hereby established, and that the
Purchasing and property Manager is hereby authorized to purchase
used vehicles without prior, individual authorization by the City
Council when all of the following conditions are satisfied:
A. A budget allocation for the vehicle has previously
been made in a Capital Improvement Program approved by the City
Council.
B. It is determined in writing by the Purchasing and
Property Manager that the city's needs which necessitate purchase
of the budgeted vehicle do not require that the vehicle be in new
condition.
C. Written notification of intent to purchase used
vehicles and City specifications are sent to, at minimum, all
approved City of Gilroy used car vendors, and to all recognized
used car dealers within the City limits.
D. Any used vehicle proposed to be purchased has been
thoroughly inspected and determined to the satisfaction of the
Equipment Maintenance Supervisor to be in acceptable condition and
to meet the city's specifications.

E. Whenever possible, at least three firm price quotes
for acceptable vehicles will be obtained, of which no less than two
quotes should be from dealers or approved vendors within the city
of Gilroy.
F. After the. offers are obtained, a vehicle will be
selected and purchased only after written authorization for the
selection and purchase is granted by the requesting department
Director, the Equipment Maintenance supervisor, and the Purchasing
and Property Manager.
G. After a vehicle is purchased, the Purchasing and
Property Manager shall report the details of the purchase to the
City council at the next available Council meeting.
