RESOLUTION NO. 92- 11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY TAKING CERTAIN ACTIONS REQUIRED BY
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND
ADOPTING A SOURCE REDUCTION AND RECYCLING
ELEMENT AND A HOUSEHOLD HAZARDOUS WASTE
ELEMENT FOR INCLUSION IN THE SANTA CLARA
COUNTY INTEGRATED WASTE MANAGEMENT PLAN
WHEREAS, Public Resources Code sections 41000 and 41500
require all cities in California to prepare, adopt, and submit to
the county a Source Reduction and Recycling Element and a Household
Hazardous Waste Element for inclusion in the County's Integrated
Waste Management Plan; and
WHEREAS, Negative Declarations M9l-07 for the Source
Reduction and Recycling Element, and M9l-08 for the Household
Hazardous Waste Element were prepared and submitted for public
review in accordance with the requirements of the California
Environmental Quality Act; and
WHEREAS, on the 3rd day of February, 1992 the city
Council held a duly noticed public hearing on the Source Reduction
and Recycling Element and the Household Hazardous Waste Element;
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council hereby finds that:
1. There is no substantial evidence before the
city that either project may have a significant effect on the
environment; and
2. The City has properly taken all actions
required by the California Environmental Quality Act in conjunction
with each project; and
3. Mitigated Negative Declarations M9l-07 and
M9l-08, copies of which are attached hereto as Exhibits "A" and
"B", respectively, and incorporated herein by these references,
should be and hereby are approved; and
B. The mitigation monitoring programs required by
RESOLUTION NO. 92 - 11

Public Resources Code section 21081.6, attached hereto as
Exhibits "C" and "D" and incorporated herein by these references,
are hereby adopted; and
C. The Source Reduction and Recycling Element and a
Household Hazardous Waste Element should be and hereby are adopted,
and the City Clerk is directed to forward copies thereof to Santa
Clara County as provided by statute.

An Initial Study of this project was undertaken and prepared for the
purpose of ascertaining whether this project might have a significant
effect on the environment. A copy of this study is on file at the City of
Gilroy Planning Department, 7351 Rosanna Street, Gilroy, CA 95020.
FINDINGS & REASONS:
The Initial Study identified potentially significant effects on the
environment. However, the applicant has agreed to specific revisions in
the project and/or the project has been revised. See the MITIGATION
MEASURES listed below, which avoid or mitigate the effects to a point where
no significant effects will occur. There is no substantial evidence the
project, as revised, may have a significant effect on the environment. The
following reasons will support these findings:
(A) The proposed project is consistent with the adopted goals and policies
of the General Plan of the City of GilroY1
(B) Any proposed development- of a significant scale will have an
independenu environmen~al.assesBrnent to evaluate site specific
environmental concerns1
(C) The proposal will not be detrimental to the public welfare or
injurious to property; and

MITIGATION MEASURES:
1. If the City of Gilroy implements the fee structure alternative, an
anti-dumping ordinance should be adopted. In conjunction with this
process, the City shall determine the monitoring and enforcement needs,
and demands on the relevant city departments.
2. The City of Gilroy shall monitor the fee structure programs by
measuring waste types and quantities being disposed of, and monitor the
number of complaints and incidents of illegal dumping. If objectives
are not being met, the City should consider re-evaluation of the
diversion goals, public awareness campaign, and options of
implementation and enforcement.
3. Prior to the implementation of the residential on-site compo sting
program, the City of Gilroy shall develop strategies for effective
means of promoting proper management through public education,
publicity, and monitoring. These may include ndo-it_yourselfn
compo sting kits, self-guides to composting, school-oriented educational
campaigns, and publicity efforts.
4. Prior to the implementation of the salvage recovery alternative, a
comprehensive operations plan shall be prepared. This plan shall
address worker safety provisions, truck circulation, and operation
procedures. This plan shall be subject to the review and approval of
the appropriate city departments.
5. Prior to the implementation of the expanded curbside recycling program,
the City of Gilroy shall develop a pamphlet style manual providing
general informatiqn on the expanded program as well as guidance in the
proper storage and use of recycling bins.
6. Following the implementation of the expanded recycling program, the
City of Gilroy should periodically monitor and survey residents to
ascertain the level of satisfaction with the program. If visual
impacts are raised as a concern, the City shall work with the multi-
family unit and/or business industry to arrange a solution for properly
storing the recycling bins.

dispose of waste shall be licensed hazardous waste hauls. In
addition, the City shall develop a plan for coordination with the
County Environmental Health staff for record keeping and monitoring
for compliance of handlers and haulers of hazardous wastes. The City
should specifically detail plans to monitor its own contractors. In
addition, the City should coordinate with the County Environmental
Health Department to perform monitoring and compliance inspection
activities at all periodic drop-off events and Household Hazardous
Waste (HHW) disposal activities at the San Martin Transfer station.
