Resolution 1992-36 . . , RESOLUTION NO. 92 - 36 RESOLUTION OF THE CITY OF GILROY ADOPTING THE UNIFORM BUILDING, PLUMBING, MECHANICAL, HOUSING AND ABATEMENT, AND ADMINISTRATIVE CODES 1991 EDITIONS, WITH MODIFICATIONS WHEREAS, Section 6.1 of the Gilroy Code provides that the latest edition of the Uniform Construction Codes shall be submitted to the COlIDcil to become effective within the City upon approval by resolution, subject to possible modifications and amendments; and WHEREAS, 1991 editions of the various Uniform Construction Codes have been submitted with some some modifications and amendments and recommended by the Chief Building Official for Council approval as set forth below: NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY that the following Codes, with the modifications set forth, are adopted and shall apply to all construction in the City of Gilroy. UNIFORM BUILDING CODE The Uniform Building Code, 1991 Edition, and the appendix thereto excepting appendix chapters 1, 7, 10, 12, 23 except Division II, III, and IV, 24, 25, 26, 51, 53, and 57 is adopted with the following amendments: 1. Delete Section 301 (b) 5, retaining walls not over 4' in height. 2. Addition to Section 2308 (b): of concrete or masonry and be designed Engineer or shall conform to standards Retaining waIls shall be constructed by a California State Licensed available at the Building Department. 3. Delete Section 2517 (g) 3-E & G, gypsum-board sheathing and portland cement plaster. 4. Delete the reference to foundation bolts not more than 6' apart in Section 2907 (f) and substitute therefore "foundation bolts shall be spaced not more than 4' apart". -1- RESOLUTION NO. 92 - 36 . . , 5. Add paragraph F to Section 3204 to read: Regardless of other requirements contained in this section, all roof coverings hereafter constructed in areas of the City that have been designated to be a hazardous fire area due to vegetation, topography, water supply or access, shall have non-combustible roof coverings as specified in Section 3204 (a). Refer to Hazardous Fire Area maps on file in the City of Gilroy Planning Department and Fire Department. 6. Delete group R Division 3 and group M exception in Section 3802 (b). 7. Add new sub section (I) to Section 3802 to read: In addition to the requirements of this code, an automatic sprinkler system sball be ins taIled as fol1ows: Any building or group of buildings where in the judgment of the fire Chief, such building or group of buildings due to size, height, type of construction, location on property, contents or occupancy classification would exceed or severely tax the capabilities of the 10cal fire department to perform a reasonable level of rescue and fire suppression, the fire flow for each building wil1 be determined utilizing the Insurance Services Office basic fire flow formula. F= (18xC) X ~ where F= required fire flow in gallons per minute C= coefficient related to type of construction A= total floor area (including basement) .6 type I & II fire resistive construction .7 type II one hour construction .8 type II non rated construction .9 type III one hour construction 1.0 type III non rated construction .9 type IV construction 1.25 type V one hour construction 1.5 type V non rated construction Regardless of area or occupancy separation waIls, when more than 1500 gal Ions per minute fire flow is required, the building shall be equipped with an automatic fire sprinkler system. Such buildings shall include, but not be limited to: -2- RESOLUTION NO. 92 - 36 . . , a. All buildings three stories or thirty feet in height; or b. buildings where limited access for fire apparatus does not permit mobile unit operations of ladder companies to within fifteen (15) feet of openings in stories as required in UBC Section 504 and 3802; or c. buildings where limited access for fire apparatus does not permit mobile use of pump and hose companies to reach all sides of building without laying more than 150 feet of fire hose. d. If a fire sprinkler system is not required for purposes other than this section, the area increases specified in section 506 (c), the height and story increases specified in section 507 and the fire resistive substitution in 508 of the Uniform Building Code may be permitted. e. Additions to existing buildings: this section shall apply to all additions to existing buildings. 1. If the entire building area including the addition exceeds the area permitted in Section 3802 (a) through 3802 (h) of the Uniform Building Code, then the entire building shall be sprinklered; or 2. If the entire building area, including the addition requires an automatic sprinkler system by this section, but the entire building is below the area specified in Section 3802 (a) through 3802 (h), the addition shall be equipped with an automatic sprinkler system and be separated from the existing building by an area separation waIl as specified in 505 (f) of the Uniform Building Code. 3. Automatic fire sprinkler systems shall be ins taIled in all R-l and R-3 buildings over five thousand (5,000) square feet in area and all buildings constructed in an RH (Residential Hillside) zoning -3- RESOLUTION NO. 92 - 36 . . district. 8. Whenever the word "Building Official" appears in Chapter 70, it shall mean Director of Public Works of the City of Gilroy. Chapter 70 shall be further amended by adding Section 7013 (c) Erosion Control: a. The applicant shall submit an Interim Erosion and Sediment Control Plan. This can be incorporated on the Grading Plan and shall include the following information: 1. Maximum surface runoff from the site as calculated using the method approved by the Director of Public Works. 2. A delineation and brief description of the surface runoff and erosion control measures to be implemented including but not limited to types and methods of applying mulches to be used. 3. And a delineation and brief description of vegetative measures to be taken, included but not limited to, seeding methods, the type, location and extent of existing and undisturbed vegetation types, and a sch edule for main tenance and upkeep. b. No Improvements Planned. Where an applicant does not pIan to construct permanent improvements on the site, or plans to leave portions of the site graded but unimproved, applicant must: 1. Submit an Interim Plan designed to control runoff and erosion on the site for the period of time during which the site, or portions thereof, remain unimproved and: 2. Submit a request for release after the completion of grading. c. Work Schedule: The applicant must submit a master work schedule showing the following information: 1. Proposed grading schedule; 2. Proposed conditions of the site on each July 15, August 15, September 15, and October 15 during which the permit is in effect; -4- RESOLUTION NO. 92 - 36 . . 3. Proposed schedule for instal1ation of all interim erosion and sediment control measures including, but not limited to, the stage of completion of erosion control devices and vegetative measures on each of the dates set forth in Subsection (2); 4. Schedule for construction of final improvements, if any; 5. Schedule for installation of permanent erosion and sediment devices where required. d. Wet Season Work. (October 15 to April 15) 1. For commencement of the grading during the wet season, applicant must provide special documentation, as required by the Director of Public Works, showing the reasons other than financial, for the need to commence at that time. 2. For continuation of activities, other than installation, maintenance or repair of measures in the Interim or final plans, during the wet season, permittee must apply for and receive, every five (5) working days, special permission to proceed. 3. The Director of Public Works shal1 grant permission under this subsection on the basis of weather forecasts, experience and other pertinent factors which indicate the activity may occur without excessive erosion occurring. UNIFORM PLUMBING CODE The Uniform Plumbing Code, 1991 Edition and the appendix thereto, is adopted with the following amendments; 1. Delete Section 20.1 Organization and Enforcement 2. Section 203 (d) is amended by deletion the exception at the end of the paragraph and substituting therefore: Type M copper piping shall not be used. -5- RESOLUTION NO. 92 - 36 . . 3. Add the following sentenance to Section 318 (b) 6: The test for copper water piping shall be 100 pounds per square inch. 4. Section 1004 (a) is amended by adding the following paragraph; Copper, galvanized and plastic water piping shal1 not be installed beneath a concrete building slab. 5. Section 1008 (c) delete the reference to water piping beneath a slab. 6. Addition to Section 1009 (a). A minimum one inch water line shall be run through the house, off of which lateral lines would serve the various fixtures. This one inch line to terminate in a hose bib at the rear of house. This applies to residential sing Ie family only UNIFORM MECHANICAL CODE The Uniform Mechanical Code, 1991 Edition, and the appendix thereto, is adopted. UNIFORM HOUSING CODE The Uniform Housing Code, 1991 Edition, is adopted. UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS The Uniform Code for the Abatement of Dangerous Buildings, 1991 Edition, is adopted. UNIFORM ADMINISTRATIVE CODE The Uniform Administrative Code, 1991 Edition, is adopted. That a copy of this resolution be kept in the office of the Chief Building Of tidal.
