Resolution 1992-37 . . RESOLUTION NO. 92 - 37 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MAKING FINDINGS REGARDING CHANGES AND MODIFICATIONS OF THE UNIFORM BUILDING AND UNIFORM FIRE CODE WHEREAS, the City Council of the City of Gilroy has heretofore adopted the latest edition of the Uniform Building code, Lniform Mechanical Code, Uniform Plumbing Code, National Electrical Code, Uniform Housing, Administrative and Abatement Codes, and the Uniform Fire Code pursuant to the authority set forth in Section 17922 of the Health and Safety Code as the construction codes of the City of Gilroy; and WHEREAS, Section 17958.5 and Section 17958.7 of the Health and Safety Code authorize the City to make changes or modifications in such codes as deemed reasonably necessary because of local conditions, upon express findings that such modifications are needed; and WHEREAS, certain local conditions have justified and now justify modifications in such codes, by the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy, State of California, that it hereby finds and determines that the following designated changes or modifications are reasonably necessary because of local conditions set forth hereafter: 1. THE UNIFORM BUILDING CODE/L~IFORM FIRE CODE The Uniform Building and Uniform Fire Code is adopted because certain local conditions in the City of Gilroy require the adoption of a Uniform Fire Code for adequate fire prevention and auppression measures. The City of Gilroy is subject to possible severe earthquake hazards. The City must maintain uniform standards with respect to fire prevention in order to minimize the potential of severe fire danger and damage caused by earthquakes. -1- RESOLUTION NO. 92 - 37 .' !! . . - Portions of the City of Gilroy are in hillside hazardous fire areas that have limited fire suppression forces available. For the protection of life and property in those areas, adoption and enforcement of a Uniform Building Code and a Uniform Fire Prevention Code is necessary. 2. AMENDMENTS IMPACTING HOUSING The fire fighting capabili ties of the fire suppression forces are limited. Generally, protection of multi-family dwellings and other buildings three stories or 30 feet in beight, or that require a fire fow in excess of 1500 gal10n per minute are beyond the capabilities of the fire suppression services. Therefore, where multi-family dwelling and other buildings are in excess of three stories or 30 feet in height, or require a fire flow greater than 1500 gallons per minute, it is necessary they have installed an automatic fire sprinkler system to extinguish fires. Additionally to provide a source of water at tbe building site when fire apparatus is not able to access tbe structure, a wet stand pipe system is required. Furthermore, the City of Gilroy is subject to a high risk of serious earthquakes. In multi-family and other building s 30 feet or more in height, or more than 1500 gallons per minute, there exists a greater risk of a serious fire resulting from earthquakes. Since automatic sprinkler systems are installed with earthquake bracing to protect against physical damage in the event of building movement, the potential for a serious fire in these types of buildings is greatly reduced and, likewise the total fire damage likely to result from a severe earthquake is also reduced. Finally, certain hazardous fire areas of the City due to a combination of weather, vegetation and topography, necessitate the requirement of residential fire sprinklers and non-combustible roofing on new buildings, including dwellings. -2- RESOLUTION No. 92 - 37 .< , . . -~- ..
