RESOLUTION NO. 92 - 38
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MAKING FINDINGS
REGARDING CHANGES AND MODIFICATIONS OF THE UNIFORM PLUMBING CODE
WHEREAS, the City Council of the city of Gilroy has heretofore adopted the
latest Edition of the UnHorm Building Code, Uniform Mechanical code, National
Electrical Code, Uniform Plumbing Code and the Uniform Fire Code pursuant to the
authority set forth in Section 17922 of the Health and Safety Code as the
construction codes for the City of Gilroy; and
WHEREAS, Section 17958.5 and 17958.7 of the Health and Safety Code authorize
the City to make changes or modifications in the codes as deemed necessary because
of local conditions, upon express findings that such modifications or changes are
needed; and
WHEREAS, certain local conditions have justified and now justify modifications
in such codes, by the City Council.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy, State
of California, that it finds and determines that the following designated changes
or modifications are reasonably necessary because of 10cal conditions set forth
hereafter:
1. UNIFOIDl PLUMBING CODE
The Uniform Plumbing Code is adopted to insure a safe and workable
plumbing system with minimum regulations.
The City of Gilroy has experienced numerous water piping failures in type
"M" copper piping and to a lesser extent in type "L" beneath building slabs.
Engineering studies have been done, however to date there are no conclusions as to
cause. Since eliminating type "M" copper piping in the City, the incidence of
failure has greatly decreased.

2. AMENDMENTS IMPACTING HOUSING
The Uniform Plumbing Code is therefore amended to delete all water piping
beneath a building slab and to delete Type "M" copper water piping in the City.
The higher initial cost of installation will be offset by fewer failures and a
lower cost to repair if failure does occur. Minimal impact to housing.
