Resolution 1992-40 . . RESOLUTION NO. 92 - 40 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING UNIFORM FIRE CODE, 1991 EDITION, WITH MODIFICATIONS AND THE CALIFORNIA FIRE CODE WHEREAS, Section 10.9 of the Gilroy City Code provides that the latest edition of the Uniform Fire Code shall be submitted to the Council to become effective within the City upon approval by resolution, subject to possible modifications and amendments; and; WHEREAS, the State of California has adopted the California Fire Code and the City of Gilroy Fire Department is responsible for inspecting State regulated occupancies; and WHEREAS, the 1991 edition of the Uniform Fire Code has been submitted and recommended by the Fire Chief for Council approval, with modifications and amendments. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Gilroy that the California Fire Code and the Uniform Fire Code, including appendices: I-C - Stairway Identification, II-A - Suppression Control of Hazardous Fire Areas, II-B - Protection of Flammable and Combustible Liquids in Tanks in Locations Subject to Flooding, II-D - Rifle Ranges, II-E - Hazardous Materials Management Plan and Hazardous Material s Inven tory Statements, III-A - Fire-flow Requirements for Buildings, III-B - Fire Hydrant Locations and Distribution, III-C - Testing Automatic Sprinkler and Standpipe Systems, I II -D - Basement Pipe Inlets, IV-A - Interior Floor Finish, IV-B - Christmas Trees, V-A - Nationally Recognized Standards of Good Practice, VI-A - Hazardous Materials Classification, VI-B - Emergency Relief Venting for Fire Exposure for Above ground -1- . . Tanks, VI-C - Model Citation Program, VI-D - Reference Tables from the Uniform Building Code, VI-E - Unit Conversion.Tables and VII - High-Rise Buildings, and any fees or charges set forth therein is adopted and shall apply within the City of Gilroy with the following modifications attached, marked "Exhibit A". EXHIBIT "A" Amend to read - Board of Appeals Section 2.303 The Board of Appeals used by the City Bniltiing Department shall be the same board used by the Fire Department. Section 10.302(b) - ErrErgency Infonnation Box When an occupancy contains storage of hazardous ll'aterials that exceed the exempt arrounts listed in Article 80 of the UnifoDIl Fire Code, or the occupancy is required by the Chief to have available on-site prefire plans, the Chief Il'aY require an approved emergency infonnation box be installed at an approved location on the premises for the storage of such infOIlIlation. The emergency infonnation box shall be installed in an accessible location and the enclosed infoIlIlation shall be periodically updated by the occupant. Section lO.302(c) - Pre-fire and Emergency Planning When deemed necessary to provide for protection of life or property, the Chief Il'aY require the owner or operator of any occupancy regulated by this code to develop and inplenent a pre-fire and emergency plan. . . Section lO.507(b) - Required Installation of AutClIl3.tic Fire- extinguishing Systems In addition to the requirenents of this code, an autrnJatic sprinkler system shall be installed as follCMS: lIDy building or group of bl1ilrliTlgs where in the judgerrent of the Fire Chief, such buildings or group of buildings due to size, height, type of construction, l=ation on property, contents = occupancy classification would exceed = severely tax the capabilities of the local fire department to perfonn a reasonable level of rescue and fire suppression. If the entire building area including the addition exceeds the area pennitted in Section 3802(a) through 3802(h) of the UnifODll Building Code, then the entire building shall be sprinklered; = 2. Section 10.508 - Sprinkler System Supervision Alanns All valves controlling the water supply f= autanatic sprinkl.er systems and water-flON switches on all sprinkler systems shall be electrically supervised. Valve supervision and water-flON alann and trouble signals shall be distinctly different and shall be autanatically transmitted to an approved central station, rerrote station or proprietary supervising stations as defined by national standards, = when approved by the building official with concurrence of the Chief, sound an audible signal at a constantly attended location. EXCEPTION: 1. Underground key = hub valves in roadway boxes provided by the numicipality or public utility need not be supervised. 2. Fire sprinkler systems supplied by darestic water supply. Section 29.103(b) - Dispensing Inside Buildings Class I liquids shall not be dispensed or transferred within a repair garage, except as provided in Section 79.903(h). Class II and Class III -A liquids are allCMed to be dispensed in lubrication or service roans, provided the electrical equiptent carplies with Section 79.905 and heating equiptent cCXIlJ?lies with Section 79.906. For dispensing operations outside or frem special enclosures see Article 79, Division IX. Section 29.103(c) - Pits Class I liquids shall not be stored or used within a building having a basenent or pit into which flanrrable vapors could travel, unless such area is provided with ventilation designed to prevent the accunulation or vapors. Section 29.103(d) - Drainings 1. Fuel Tank Drainings The storage and handling of fuel tank drainings within buildings classified as Group H, Division 4 occupancies shall be in accordance with Article 79 for Class I or II liquids. Fuel tank drainings in buildings classified as Group B, Division I occupancies are not pennitted. 2. Lubrication Drainings Lubrication drainings shall be stored and handled in accordance with the requirenent of Article 79 for Class III-B liquids. 3. Mixed Drainings Containers or tanks containing both fuel and waste lubrication drainings are pennitted when the containers or tanks are installed in accordance with the requirenents of Article 79 for Class I or II liquids. Section 29.103(e) - storage Liquids stored inside of buildings shall be kept in containers or tanks cCXIlJ?lying with Article 79, Division II and III. Liquids stored outside shall be kept in containers or tanks carplying with Article 79, Division IV or V. Drainage lines for tanks terminating inside a building shall be equipped with a nonrerrovable-type cap, such as a hinged cap. . . Section 29.103(f) ~ Spill Control spill control shall be provided in accordance with 79.115. Section 29.103(g) - Oily Waste Materials Oily rags and similar materials shall be st=ed in netal, netal lined, or other approved containers equipped with tight-fitting covers. Section 29.104(a) - Portable Appliances and Equipnent Portable Appliances and equiprent = other sources of ignition shall not be within 18" of the floor. Section 29.104(b) - Sources of Ignition Sm:lking and open flaIres shall be prohibited in areas used f= servicing internal canbustion engines. Section 29.104(c) - Welding Welding operations shall be =nducted in Group H, Division 4 occupancies and shall be in accordance with Article 49. section 45.207 - Limited Spraying Areas Limited spraying (spotting = touch-up) shall be =nducted only in approved spray booth or spraying roans. Section 79.501(a) - Limits Defined The storage of flannab1e and canbustible liquids as defined in Section 9.108 and 9.105 in outside, aboveground tanks and underground tanks is prohibited in the follcMing zoning classifications as defined by the City of Gilroy zoning map. 1. The design of the sprinkler system shall not be less than that required by the Building Code for Ordinal:y Hazard Group 3 with a mi.nimum design area of 3,000 square feet. See U.B.C. Where the materials or storage arrangement require a higher level of sprinkler system protection in accordance with nationally recognized standards, the higher level of sprinkler system protection shall be provided. Part 2, Title 24, C.A.C., Chapter 2-18" Section 2-1807 (a) 1 is arrended to read, "In addition to other applicable requirerrents of these regulations, the provisions of this section shall apply to every new building of any type construction or =upancy having floors used for human occupancy lo::ated nore than fifty (50) feet above the lowest floor level having building access." . .
