RESOLUTION NO. 92- 41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY DIRECTING CITY AGENCIES THAT HAVE
ADOPTED CONFLICT OF INTEREST CODES TO REVIEW
THOSE CODES AND REPORT BACK TO THE CITY
COUNCIL AS REQUIRED PURSUANT TO GOVERNMENT
CODE !i 87306 (a)
WHEREAS, the California Political Reform Act, California
Government Code !i 81000 et seq. (the "Act"), requires city councils
to ensure that city agencies have adopted and implemented conflict
of interest codes in compliance with the Act's requirements; and
WHEREAS, !i 87306.5 of the California Government Code
provides that, no later than July 1 of each even-numbered year,
city councils shall direct every city agency which has adopted a
conflict of interest code in accordance with the Act to review that
agency's code and report back to the city council by October 1 as
to whether changed circumstances necessitate any amendments to the
code to meet the Act's requirements; and,
WHEREAS, !i 87306(a) of the California Government Code
requires that agencies amend their conflict of interest codes in
response to changed circumstances within 90 days of such time that
such changed circumstances necessitating amendment have first
become apparent, and submit such changes to the city council;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. Every agency of the city of Gilroy which has adopted
a conflict of interest code as required by the Act is hereby
directed to review that agency's conflict of interest code and to
make any changes to that code as may be necessary in response to
circumstances changed since the code was enacted or last amended;
2. Every such agency shall submit a written report
signed by the head of the agency to this City council no later than
October 1, 1992 stating one of the following:

(a) the agency believes after reviewing its code
that no amendments to the existing code are necessary; or
(b) the agency's review shows that an amendment is
necessitated by changed circumstances and will amend its code; or
(c) the agency's review showed that an amendment
was necessitated by changed circumstances, and the agency has
already amended its code and has attached a copy of the amended
code for review by the city Council; and
3. In the case an agency whose response states item (b)
above, the agency shall amend its code as necessary and submit the
revised code no later than January 1, 1993 to the City Council for
review.
