RESOLUTION NO. 92- 47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ORDERING THE REORGANIZATION OF
APPROXIMATELY 2.436 ACRES OF LAND ON THE NORTH
SIDE OF COHANSEY AVENUE, AT TERRI COURT,
ANNEXATION TO THE CITY OF GILROY AND
DETACHMENT FROM THE SOUTH SANTA CLARA COUNTY
FIRE DISTRICT (TERRI COURT/COHANSEY AVENUE
REORGANIZATION 91-03)
WHEREAS, pursuant to Part 1 of Title 5, Division 3,
commencing with Section 56000 of the California Government Code,
lead petitioner Dr. Gallo, et al., has petitioned for annexation
to the city of Gilroy of approximately 2.436 acres of land on the
north side of Cohansey Avenue, at Terri court, consisting of one
contiguous parcel numbered APN 835-14-040, known as Terri Court/
Cohansey Avenue Reorganization 91-03, and described in the legal
description and shown on the map attached hereto as Exhibit "A" and
incorporated herein by this reference; and
WHEREAS, no additional consents are required for the
annexation because lead petitioner is the owner of the entire
affected parcel; and
WHEREAS, the reason for this reorganization is that the
affected lands are contiguous to the City of Gilroy, making
annexation a logical extension of city limits to lands whose use
and development the city should control and detachment a logical
transfer of fire services from a county entity to the City; and
WHEREAS, this proposal is consistent with the Sphere of
Influence of Gilroy; and
WHEREAS, the regular county assessment roll will be used
for taxes and assessments on the lands to be annexed; and
WHEREAS, on December 20, 1989, the city Council approved
a negative declaration in conjunction with a General Plan amendment
(GPA 89-008) based on an initial study finding that there would be
no significant effects on the environment as a result of this
project; and

WHEREAS, the lands proposed to be annexed are unincor-
porated territory within Santa Clara County which is within the
urban service area of the City of Gilroy so that, pursuant to
Government Code section 56826, the Santa Clara County Local Agency
Formation Commission (LAFCO) shall not review this reorganization,
and the City Council is the conducting authority for the reorgani-
zation; and
WHEREAS, the consent of all owners of land within the
affected territory makes notice and a public hearing unnecessary
prior to completing this reorganization;
NOW, THEREFORE, BE IT RESOLVED THAT the city Council of
the City of Gilroy hereby finds as follows:
A. That this reorganization includes the annexation to
the city of unincorporated territory within the urban service area
of the city as adopted by LAFCO; and
B. That the County Surveyor has determined the
boundaries of the proposal to be definite and certain, and in
compliance with the road annexation policies of the Commission; and
C. That the proposal does not split lines of assessment
or ownership; and
D. That the proposal does not create islands or areas
in which it would be difficult to provide municipal services; and
E. That the proposal is consistent with the adopted
General Plan of the city; and
F. That the territory is contiguous to existing City
limits; and
G. That the city has complied with all conditions
imposed by LAFCO for inclusion of the territory in the urban
service area of the City; and
H. The proposal will not be detrimental to the pUblic
welfare or injurious to persons or property in the vicinity; and

BE IT FURTHER RESOLVED THAT the lands described herein
are hereby ordered to be annexed to the City of Gilroy and detached
from the South Santa Clara County Fire District; and
BE IT FURTHER RESOLVED THAT the city Clerk shall submit
forthwith a certified copy of this resolution and the fees required
by Government Code section 54902.5, collected from the lead
petitioner, to the executive officer of the Santa Clara County
Local Agency Formation Commission.

TERRI COURT/COHANSEY AVENUE REORGANIZATION 91-03
AUGUST 12, 1991
(Revlsed February 18, 1992 and May 11. 1992)
ALL that certain real property situate in the County of Santa Clara, State
of California, and being more particularly described as follows:
BEGINNING at the northern most corner of Parcell, as said Parcel is
shown upon that Parcel Map filed in Book 330 at Page 10, Santa Clara County
Records, and running thence along the northeasterly boundary thereof. South
25'18' East. 270.86 feet to a corner of that annexation accepted by the City
of Gilroy entitled "Buena Vista/Las Animas 86-02", on the northwestern
right-of-way line of Cohansey Avenue (30.00 feet wide from centerline). as
said Avenue is shown upon that aforementioned Map; thence along said
northwestern right-Of-way line, being coincident with the boundary of said
annexation. South 67'42'30" West. 419.34 feet; thence leaving said
northwestern right-of-way line and annexation boundary and running along
western right-of-way line of Terri Court. as said western right-of-way line
is shown upon that Parcel Map filed in Book 330 of Maps at Page 12, Santa
Clara County Records, along a curve to the left, whose tangent bears. North
67'42'30" East. with a radius of 20.00 feet, through a central angle of
90'02'30" and an arc length of 31.43 feet; thence North 22.20' West, 250.48
feet; thence leaving said western right-Of-way line, North 67'42'30" East,
30.00 feet to the western most corner of said Parcell; thence along the
northwestern boundary of said Parcell, North 67"42'30" East, 355.31 feet to
the point of beginning and containing therein 2.436 Acres more or less.
