RESOLUTION NO. 92- 49
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY DENYING GPA 91-04, WHICH PROPOSED TO
AMEND THE GENERAL PLAN MAP OF THE CITY OF
GILROY TO CHANGE THE DESIGNATION AND DENSITY
FROM LOW DENSITY RESIDENTIAL TO MEDIUM DENSITY
RESIDENTIAL ON AN APPROXIMATELY 3-ACRE
PROPERTY LOCATED AT 8790 KERN AVENUE AND THE
PARCEL TO THE SOUTH
WHEREAS, Steven Nicholas and Leo Ludewig have submitted
GPA 91-04, to amend the Gilroy General Plan Map to change the
designation and density from Low Density Residential to Medium
Density Residential on an approximately 3-acre property located at
8790 Kern Avenue and the parcel to the south; and
WHEREAS, GPA 91-04 was reviewed and considered by the
Planning commission at a duly noticed public hearing on the 5th day
of December, 1991, and after that public hearing the Planning
commission did unanimously vote to adopt Resolution No. 91-26,
making certain findings and recommending that the City Council deny
GPA 91-04; and
WHEREAS, the city Council, after continuing the public
hearing from the 21st day of January, 1992 at the applicants I
request, conducted a duly noticed public hearing on the project on
the 15th day of June, 1992, to consider GPA 91-04 and did not
approve the Negative Declaration prepared for the project pursuant
to the California Environment Quality Act (CEQA);
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The Negative Declaration prepared for this project
in accordance with CEQA hereby is not approved; and

B. GPA 91-04 should be and hereby is denied, and the
General Plan Map of the City of Gilroy is not amended as proposed
therein or in any way.
