RESOLUTION NO. 92- 6q
A RESOLUTION OF THE CITY COUNCIL OF THE CITY,
OF GILROY TRANSFERRING AND ASSIGNING TO THE
SOUTH COUNTY REGIONAL WASTEWATER AUTHORITY THE
CITY'S INTERESTS, RIGHTS AND RESPONSIBILITIES
UNDER ORDER NO. 85-82 OF THE CALIFORNIA
REGIONAL WATER QUALITY CONTROL BOARD--CENTRAL
COAST REGION PERMITTING WASTEWATER RECLAMATION
WHEREAS, the City of Gilroy and the City of Morgan Hill
(lithe cities") by agreement of July 1, 1967 and subsequent
amendments thereto have exercised joint powers to construct,
operate, maintain and finance municipal wastewater treatment and
disposal facilities ("Municipal Facilities"): and
WHEREAS, the cities by joint exercise of powers agreement
dated May 19, 1992, have created the South County Regional
wastewater Authority (the "Authority") with broad powers to own,
operate and maintain systems, plants, buildings, works and other
facilities for the collection, treatment and disposal of sewage,
waste and storm water, including wastewater treatment and disposal
plants and works and facilities in connection therewith, and
reclamation facilities: and
WHEREAS, the California Central Coast Regional Water
Quality Control Board issued Order No. 85-82, "Water Reclamation
Requirements for Santa Clara valley Water District, cities of
Gilroy and Morgan Hill, and Gavilan Water Conservation District,
Santa Clara County, II adopted on May 10, 1985 authorizing those
cities to operate a wastewater reclamation system for reclaiming
and distributing wastewater from the Municipal Facilities: and
WHEREAS, Order No. 85-82 encompasses the cities, their
agents, successors and assigns: and
WHEREAS, the cities have concluded that all permits
issued to the cities for activities undertaken in connection with
wastewater reclamation should be assigned to the Authority.

NOW, THEREFORE, BE IT RESOLVED THAT all interests, rights
and responsibilities now held by the city of Gilroy under Order 85-
82 are hereby transferred and assigned to the Authority.
PASSED AND ADOPTED this 1st day of July, 1992 by the
following vote:
