RESOLUTION NO. 92- 78
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY MAKING CERTAIN FINDINGS AND SETTING
INITIAL RATES FOR A CITYWIDE TRAFFIC IMPACT
FEE ON ALL DEVELOPMENT PROJECTS WITHIN THE
CITY OF GILROY
WHEREAS, the City Council is considering the adoption of
Ordinance 92-..lL establishing a citywide traffic impact fee on
development projects, as the ordinance defines that term, to
finance certain street and highway improvements; and
WHEREAS, Ordinance 92-~, if adopted, requires the City
council to set the initial rates for the fee by resolution; and
WHEREAS, california Government Code Section 66001
requires that certain findings be made upon the imposition of such
fees; and
WHEREAS, the city council has duly received, reviewed,
and considered documents entitled "Citywide Traffic Impact Fee
Study" (December 1991) ("study") and "Citywide Transportation study
Technical Report" (January 1992) ("Report"), prepared by TJKM
Transportation Consultants; and
WHEREAS, the City council held a duly noticed public
hearing on this resolution on October 5, 1992, at which time the
City Council also considered Ordinance No. 92-~, and this
resolution, Ordinance No. 92- 17, the Study and the Report were
available to the public for at least 10 calendar days prior to the
hearing; and
WHEREAS, the city council has considered the effect of
the following fee rates with respect to the housing needs of the
region;
NOW, THEREFORE, BE IT RESOLVED THAT
A. The initial rates for the citywide traffic impact
fee on development projects shall be as follows:
1. single family residential: $2727 per dwelling
unit;

2. High-density residential: $2209 per dwelling
unit;
3. Retail commercial in the C-l, C-2, C-3, HC, and
CM zones: $5.907 per square foot;
4. Office commercial in the PO zone only: $2.225
per square foot;
5. Industrial/warehouse in the M-1 and M-2 zones:
$1.063 per square foot; and
B. Based upon facts in the record of the public hearing
and in the study and Report, the city council hereby finds that
there is a reasonable relationship between the amount of the fees,
as set forth above, and the cost of the improvements attributable
to the development projects on which the fee is imposed, in that:
1. a direct relationship exists between the number
of dwelling units of residential development projects and the
number of automobile trips generated by them;
2. a direct relationship exists between the square
footage of non-residential development projects and the number of
automobile trips generated by them; and
3. the quantity estimates for new development in
each fee rate category and the cost estimates for the improvements
planned, as set forth in Exhibits "A" and "B", respectively,
attached hereto and incorporated herein by this reference, are
reasonable, and the fees expected to be generated by development
projects are therefore not expected to exceed the total costs of
the improvements; and
C. This resolution shall become effective on the dates
that Ordinance 92-17 becomes effective; however, if Ordinance

92- 17 does not become effective, this resolution shall be null and
void without further action.
