Resolution 1992-86 ... . . , RESOLUTION NO. 92-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING THE PROJECT RATING SCALE FOR IMPLEMENTATION OF THE RESIDENTIAL DEVELOPMENT ORDINANCE AND ESTABLISHING SCHEDULES FOR CERTAIN ACTIONS REQUIRED BY THE RESIDENTIAL DEVELOPMENT ORDINANCE. WHEREAS, Section 50.65 of the Gilroy zoning Ordinance authorizes the city Council to adopt from time to time by resolu- tion a project Rating Scale for use in the competitive evaluation and ranking of projects under the Residential Development Ordinance ("RDO"); and WHEREAS, recent state legislation has sought to further restrict the extent of fees and other exactions which may be required of new residential developments to offset their impacts on school facilities; and WHEREAS, adequate schools are essential to the health, safety, and general welfare of the citizens of Gilroy, and high- quality schools playa recognized, significant role in the market- ability of new residential construction; and WHEREAS, Gilroy Zoning Ordinance Section 50.6l(a) states that one purpose of the RDO is to encourage a rate of growth which will not exceed the ability of the Gilroy Unified School District to provide adequate schools; and WHEREAS, establishing schedules for certain actions required by the RDO will facilitate its implementation and further the intent of the ROO as expressed in Gilroy Zoning Ordinance section 50.61; NOW, THEREFORE, BE IT RESOLVED as follows: A. section IV. C. of the existing RDO Rating Scale should be and hereby is revised to reflect the increased importance of encouraging RDO applicants to furnish adequate school facilities and mitigation, and the revised ROO Rating Scale consisting of two pages, attached hereto as Exhibit A and incorporated herein by this reference, should be and hereby is adopted by the city Council RESOLUTION NO. 92 - 86 -1- II. ",' . . pursuant to Gilroy Zoning Ordinance Section 50.65. B. The following schedules are hereby established for certain actions required by the ROO: 1. The first ten-year goal period required by Gilroy Zoning Ordinance Section 50.63(a) shall commence with calendar year 1994. 2. The public hearing required by Gilroy Zoning Ordinance section 50.63(b) shall be agendized for the first regular meeting of the city council in April. 3. Pursuant to Gilroy Zoning ordinance section 50.64(a), all ROO applications shall be submitted from the first day of May through the first day of July each year. 4. The agreement required by Gilroy zoning Ordinance section 50.67 shall be entered into prior to February 28 of the year following the assignment of a build-out schedule, or within six months after the assignment of a build-out schedule, whichever is earlier. C. The Numerical Limits pursuant to Gilroy zoning Ordinance section 50.63(b) are hereby established as set forth in Exhibit B, attached hereto and incorporated herein by this reference. EXHIBIT "A" RESIDENTIAL DEVELOPMENT ORDINANCE RATING SCALE The city Council shall examine each proposed development and shall rate each development, in relation to the other projects proposed, by the assignment of no more than the maximum number of points allowable on each of the following categories: TOTAL 173 POINTS I. LOCATIONAL FACTORS (43 points maximum - 25%) A. city Boundaries Proximity of the proposed development to existing urban development within the incorporated City limits. (0-13 points) B. Public Facilities and Utilities Proximity of the proposed development to existing park and city facilities, police service areas and fire stations; to existing development served by City streets, water and sewer lines; and to telephone, gas and electric lines. (0-15 points) C. Infilling Location of the proposed development to provide infill development in existing neighborhoods. (0-10 points) D. Safety Hazards Location of the proposed development on land free from safety hazards such as flooding, or soil subsidence, seismic shaking or slope instability. (0- 5 points) II. HOUSING MIX (36 points maximum - 21%) A. Housing Type Variety provision of housing unit types which would add to mix of housing types, or provide other residential alternatives not generally available at present. the city-wide housing (0-11 points) 8. Density Type provision of development. Variety a variety of density (e.g. single family types lots, within the proposed duplexes, and apartments.) (0-10 points) C. Housing Cost and Price Reduction Techniques Provision of housing units made affordable to persons in low and moderate income brackets through reduced construction costs and selling prices, specially-funded programs or innovative pricing and financing arrangements. Preserving Site Features Conformance of the Site Design to the natural topography, maximizing open spaces and preserving resources such as existing housing units, water recharge areas, and prime agricultural lands, etc. (0-12 points) B. Circulation Efficient design of the proposed circulation to link existing and planned transportation systems including streets, bike routes, walkways and trails. (0-15 points) C. Resource Conservation (including energy and water) Incorporation of Site and Architectural design features which will maximize the potential for energy conservation, such as solar orientation, design and landscaping. (0- 5 points) D. Site Design Coordination Coordination of the proposed development site design, circulation and other public facilities with adjacent properties and projects. (0- 8 points) IV. COMMUNITY BENEFIT FACTORS (54 points maximum - 31%) A. Cultural and Recreational Benefits provision of new facilities, such as theaters, cultural and community recreation centers, or other improvements cultural or community benefit, on the site. centers for (0- 5 points) B. Preservation of Cultural and Historic Features Preservation of historic sites or structures, or culturally or archaeologically significant sites, such as prehistoric art or artifacts, on the site. (0- 5 points) C. School Facilities - On-Site provision of land and/or buildings on the site for school facilities beyond what is required by law. (0- 6 points) D. School Benefits and Mitigation - Community-wide Provision of school facility benefits and/or impact mitigation, via funding, land, buildings and/or other methods, beyond what is required and allowed by law. (0-20 points) E. Capital Improvement Benefits Provision of public works or capital improvements beyond what is normally required which will serve the site as public benefits such as developed public parks and waterways, bikeways, bridges, public access roads, etc. (0-13 points) F.
