RESOLUTION NO. 93- 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY MAKING CERTAIN FINDINGS AND REVISING RATES FOR A CITYWIDE TRAFFIC IMPACT FEE ON ALL DEVELOPMENT PROJECTS WITHIN THE CITY OF GILROY WHEREAS, on November 2, 1992 the city Council adopted Ordinance No. 92-17 establishing a citywide traffic impact fee on development projects, as the ordinance defines that term, to finance certain street and highway improvements; and WHEREAS, Ordinance No. 92-71 authorizes the City Council to revise the rates for the fee from time to time by resolution; and WHEREAS, California Government Code section 6600l requires that certain findings be made upon the imposition of such fees; and WHEREAS, the city Council has duly received, reviewed, and considered documents entitled "Citywide Traffic Impact Fee Study" (December 1991) ("Study") and "citywide Transportation Study Technical Report" (January 1992) ("Report"), prepared by TJKM Transportation Consultants, and additional studies prepared by City staff entitled "Alternatives to Existing Traffic Impact Fee" (January 1993) and "Additional Alternatives to Traffic Impact Fee" (January 1993) (collectively, "Alternatives"); and WHEREAS, the City Council held a duly noticed public hearing on this resolution on February 16, 1993, and this resolu- tion, the Study, the Report, and the Alternatives were available to the public for at least 10 calendar days prior to the hearing; and WHEREAS, a Draft and Final Environmental Impact Report (EIR) analyzing the improvements to be build by the traffic impact fee were prepared under the City's direction and control, and the Final EIR was duly certified, and a mitigation monitoring program adopted, by the city Council on August 3, 1992, pursuant to the California Environmental Quality Act (CEQA); and RESOLUTION NO. 93 - 5 -1- . . WHEREAS, the City Council hereby finds that the rates adopted herein are for the purpose of obtaining funds for capital projects necessary to maintain service within the city's planning area, and therefore the adoption of these rates is exempt from cEQA pursuant to CEQA Guidelines section l5273(a)(4); and WHEREAS, the city Council has considered the effect of the following fee rates with respect to the housing needs of the region; NOW, THEREFORE, BE IT RESOLVED THAT A. The initial rates for the citywide traffic impact fee on development projects shall be as follows: 1. Single family residential: $2727 per dwelling unit; 2. High-density residential: $2209 per dwelling unit; 3. Low-traffic commercial: $3.00 per gross square foot; 4. High-traffic commercial: square foot; $6.083 per gross 5. General Industrial: $1.175 per gross square foot; and 6. Warehouse Industrial: $0.866 per gross square foot. B. Based upon facts in the record of the public hearing and in the Study Report, and Alternatives, the city council hereby finds that there is a reasonable relationship between the amount of the fees, as set forth above, and the cost of the improvements attributable to the development projects on which the fee is imposed, in that: 1. A direct relationship exists between the number of dwelling units of residential development projects and the number of automobile trips generated by them; 2. A direct relationship exists between the square footage of non-residential development projects in the above categories and the number of automobile trips generated by them; and RESOLUTION NO. 93 - 5 -2- . . 3. The cost estimates for the improvements currently planned (as set forth in Exhibit "A" hereto) and the quantity estimates for new development in each fee rate category are reasonable, and the fees expected to be generated by develop- ment projects are therefore not expected to exceed the total costs of the improvements. C. The City Council further finds that it has duly taken all actions required by CEQA.
