RESOLUTION NO. 93-11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ORDERING JUDICIAL FORECLOSURE ON
APN 841-69-024, FOR FAILURE TO PAY
REASSESSMENT INSTALLMENTS (LAS ANIMAS
TECHNOLOGY PARK)
WHEREAS, property owned by DelMonte Partners Limited, a
California limited partnership, Edward Sanchez, general partner,
APN 841-69-024, is located within the boundaries of Las Animas
Technology Park Refunding District No.2; and
WHEREAS, reassessment had been made on this property in
accordance with Resolution 88-31, duly passed and adopted by the
city Council at its regular meeting held May 2, 1988; and
WHEREAS, the following reassessment installments on
APN 841-69-024 became due on the dates stated:
$4,421.75 on
December 10, 1991; $4,421.75 on April 10, 1992; and $4,477.50 on
December 10, 1992; and
WHEREAS, as of the date of this resolution, none of the
reassessment installments specified above have been paid;
NOW, THEREFORE, BE IT RESOLVED THAT:
A. Pursuant to Streets and Highways Code section
8834 (e), the city Council hereby orders the City Attorney to
commence a jUdicial foreclosure action in the name of the city
against all persons holding any interest in APN 841-69-024,
pursuant to the Refunding Act of 1984 for 1915 Improvement Backed
Bonds and the related provisions of the Improvement Bond Act of
1915 which are incorporated therein; and
B. Pursuant to Streets and Highway Code section
8834(e), the city Council hereby relieves the county tax collector
of its duty to collect the delinquent installments specified in
this resolution.
