RESOLUTION NO. 93-15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ORDERING THE REORGANIZATION OF
APPROXIMATELY 16.5 ACRES OF LAND ON THE
NORTHEAST CORNER OF LEAVESI.,EY ROAD AND SAN
YSIDRO AVENUE, FOR ANNEXATION TO THE CITY OF
GILROY AND DETACHMENT FROM THE SOUTH SANTA
CLARA COUNTY FIRE DISTRICT (LEAVESLEY/SAN
YSIDRO REORGANIZATION 92-01)
WHEREAS, pursuant to Part 1 of Title 5, Division 3,
commencing with section 56000 of the California Government Code,
petitioner Glen Lema Corporation has petitioned for annexation to
the city of Gilroy of approximately 16.5 acres of land on the
northeast corner of Leavesley Road and San Ysidro Avenue, con-
sisting of two parcels numbered APN 835-04-0l7 and -042, known as
Leavesley/San Ysidro Reorganization 92-01 and described in the
legal description and shown on the map attached hereto as Exhibit
"A" and incorporated herein by this reference; and
WHEREAS, the owners of all affected parcels have
consented to the annexation, as demonstrated by the document
attached hereto as Exhibit "B" and incorporated herein by this
reference; and
WHEREAS, the reason for this reorganization is that the
affected lands are contiguous to the city of Gilroy, making
annexation a logical extension of City limits to lands whose use
and development the city should control and detachment a logical
transfer of fire services from a county entity to the City; and
WHEREAS, this proposal is consistent with the Sphere of
Influence of Gilroy; and
WHEREAS, the regular county assessment roll will be used
for taxes and assessments in the lands to be annexed; and
WHEREAS, on September 21, 1992 the City council duly
certified an environmental impact report in connection with an
amendment to the City of Gilroy'S general plan redesignating the

subject parcels to General services Commercial, pursuant to the
California Environmental Quality Act; and
WHEREAS, the lands proposed to be annexed are unincor-
porated territory within Santa Clara County which is within the
urban service area of the City of Gilroy so that, pursuant to
Government Code section 56826, the Santa Clara County Local Agency
Formation Commission (LAFCO) shall not review this reorganization,
and the City Council is the conducting authority for the reorgani-
zation; and
WHEREAS, the consent of all owners of land within the
affected territory makes notice and a public hearing unnecessary
prior to completing the reorganization;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of
the city of Gilroy hereby finds as follows:
A. That this reorganization includes the annexation to
the City of unincorporated territory within the urban service area
of the City as adopted by LAFCO; and
B. That the County Surveyor has determined the
boundaries of the proposal to be definite and certain, and in
compliance with the road annexation policies of the commission; and
C. That the proposal does not split lines of assessment
or ownership; and
D. That the proposal does not create islands or areas
in which it would be difficult to provide municipal services; and
E. That the proposal is consistent with the adopted
general plan of the City; and
F. That the territory is contiguous to existing City
limits; and
G. That the City has complied with all conditions
imposed by LAFCO for inclusion of the territory in the urban
service area of the city; and

BE IT FURTHER RESOLVED THAT the lands described herein
are hereby ordered to be annexed to the City of Gilroy and detached
from the South Santa Clara County Fire District; and
BE IT FURTHER RESOLVED THAT the City Clerk shall submit
forthwith a certified copy of this resolution and the fees required
by government Code section 54902.5, collected from the lead
petitioner, to the executive officer of the Santa Clara county
Local Agency Formation Commission.

DESCRIPTION FOR ANNEXATION
BEING a portion of Lots 2 and 3 as shown on "Map of the Gilroy
Land Co's Suburban Tract", being the original Lot 36 of the
Partition of the Las Animas Rancho, Santa Clara County,
California, which map was filed for record on November 16, 1905 in
Book F2 of Maps at page 37, Records of Santa Clara County,
California, and being more particularly described as follows:
BEGINNING at the most northererly corner to Whitehurst Annexation
69-1 to the City of Gilroy as described in Ordinance Number 863 of
said City adopted August 8, 1969; thence along the northeasterly
line thereof S,25021'39"E. 270.00 feet to an intersection with the
northwesterly line of Leavesley Road, as shown on said Map, at the
most westerly corner of "Leavesley Annexation No.1" to the City
of Gilroy as described in Ordinance Number 930 of said City
adopted July 19, 1971; thence along the northeasterly line of
Leavesley Road and said Annexation N.64039'07"E. 166.46 feet to an
intersection with the southwesterly line of "Marcella Annexation
70-7 to the City of Gilroy" as described in Ordinance 907 of said
City adopted January 21, 1971, being in the line common to Lots 2
and 3, above referred to: thence along said southwesterly
annexation line and the line common to said Lots 2 and 3
N.25021'39"W. 170 feet to the most westerly corner to said
"Marcella Annexation 70-7"; thence along the northwesterly line of
said Annexation N.64039'07"E. 406.47 feet to an intersection with
the northeasterly line of said Lot 3; thence along said
northeasterly line N.25021'39"W. 901.29 feet to the most
northerly corner of Lot 3; thence along the line common to Lots 3,
4 and 2 S.64039'14"W. 792.93 feet to the intersection thereof with
the northeasterly line of San Ysidro Avenue (formerly Whitehurst
Avenue), as shown on said map, being also in the northeasterly
line of "Freeway-San Ysidro Avenue Reorganization 83-1" Annexation
to the City of Gilroy as described in Resolution 84-15 of said
City adopted February 6, 1984; thence along said northeasterly
line S.25021'39"E. 801.32 feet to a corner of said Whitehurst
Annexation 69-1; thence along the northwesterly line of said
Whitehurst Annexation 69-1 N.64039'07"E. 220.00 feet to the point
of beginning.
