RESOLUTION NO. 93- 17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ADOPTING USA 92-01 AND APPLYING TO
THE LOCAL AGENCY FORMATION COMMISSION OF SANTA
CLARA COUNTY FOR CERTAIN MODIFICATIONS TO THE
URBAN SERVICE AREA OF THE CITY OF GILROY, TO
INCLUDE APPROXIMATELY 176.68 ACRES LOCATED
NORTH OF PACHECO PASS HIGHWAY ANb EAST OF
HIGHWAY 101 AND CONTIGUOUS TO CITY LIMITS
WHEREAS, Kimball Small Properties, Inc. has filed with
the City of Gilroy petitions on the forms prescribed by the Santa
Clara County Local Agency Formation Commission ("LAFCO") which
request modification of the City's Urban Service Area to include
APNs 841-18-042 to -044, as shown on the attached map (Exhibit A,
attached hereto and incorporated herein by this reference),
contiguous to the City's existing Urban Service Area and located
north of Pacheco Pass Highway and east of Highway 101 and bounded
on the north by the Ronan Channel between Highway 101 and Llagas
Creek, and has prepared a "Plan for Services" that adequately
addresses fiscal impacts of the project on the City and County; and
WHEREAS, the City caused to be prepared under its
direction and control and pursuant to the requirements of the
California Environmental Quality Act ("CEQA") a Final Environmental
Impact Report ("EIR") in connection with a project which encom-
passes the request, and the City Council certified the EIR pursuant
to CEQA and made all required findings after a duly noticed public
hearing on March 15, 1993; and,
WHEREAS, the Planning Commission, after a duly noticed
public hearing on April 1, 1993, adopted Resolution 93-14 recom-
mending to the City Council that application USA 92-01, expanded
in furtherance of contiguity to include APNs 841-18-012, -049, and
-050, for a total area of approximately 176.68 acres, be forwarded
to LAFCO; and,
WHEREAS, the city Council considered the application USA
92-01 at a duly noticed public hearing on April 19, 1993;

NOW, THEREFORE, BE IT RESOLVED THAT:
A. The city council hereby finds that:
1. The City has properly taken all actions
required by CEQA; and
2. Approval of USA 92-01, with the modifications
recommended by staff and the Planning Commission, would be a
logical extension of the City's Urban Service Area and would be
consistent with the City's General Plan; and
3. There is a demonstrated need for developable
commercially designated land in this vicinity, and the present and
probable future capacity of public facilities and public services
will be adequate to meet the needs of commercial development.
B. USA 92-01, with the modification recommended by
staff and the Planning Commission, should be and hereby is for-
warded to LAFCO with a request that LAFCO approve the same to
include the approximately 176.68 acres located north of Pacheco
Pass Highway and east of Highway 101, APNs 841-18-042, -043, -044,
-012, -049 and -050 within the City of Gilroy'S Urban Service Area
for 1993.
C. The city Clerk shall file a certified copy of this
resolution with the executive officer of LAFCO.
