Resolution 1993-19 . , RESOLUTION NO. 93- 19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING AjS 92-26, AN APPLICATION FOR A PLANNED UNIT DEVELOPMENT FOR PHASE ONE OF A PROFESSIONAL OFFICE AND COMMERCIAL USE COMPLEX, INVOLVING A BANK AND ADJACENT OFFICE SPACE ON APPROXIMATELY 5.2 ACRES LOCATED AT THE NORTHEAST CORNER OF SANTA TERESA BOULEVARD AND FIRST STREET, APN 790-39-027 WHEREAS, South Valley National Bank has submitted AjS 92- 26, an application for Planned unit Development, for the purpose of developing a complex of professional office and commercial uses on an approximately 5.2 acre site located at the northeast corner of Santa T~resp- Boulevard and First Street, APN 790-39-027, as such land is shown on the map attached hereto as Exhibit A and incorporated herein by this reference; and, WHEREAS, the city has prepared and circulated in accordance with the California Environmental Quality Act ("CEQA") a Negative Declaration, including mitigation measures, for this project, attached as Exhibit B and incorporated herein by this reference; and WHEREAS, the Planning commission at its regular meeting on April 1, 1993, voted to recommend that the City Council approve the Negative Declaration and adopted Resolution 93-15 recommending that the city Council approve AjS 92-26 subject to certain condi- tions and the mitigation measures of the Negative Declaration; and, WHEREAS, the City Council at its regular meeting on April 19, 1993, did approve the Negative Declaration for this project, finding as follows: 1. That the Negative Declaration for this project reflected the independent judgment of the city; and, 2. That there was no substantial evidence before the City Council that the project as mitigated may have a signifi- cant effect on the environment; RESOLUTION NO. 93 - 19 -1- . , NOW, THEREFORE, BE IT RESOLVED THAT: A. The mitigation monitoring program required by Public Resources Code section 21081.6 for this project, as set forth in Exhibit C and incorporated herein by this reference, is hereby adopted, B. The City Council finds that the City has properly taken all actions required by CEQA. C. Based upon the application, the Planning Depart- ment's staff reports, and the evidence and testimony presented at the pUblic hearings of April 1 and April 19, the Council further finds that the proposal: 1. Conforms to the Gilroy General Plan in terms of general location and standards of development; 2. Provides the type of development which will fill a specific need of the surrounding area; 3. Does not require urban services beyond those which are currently available; 4. Provides a harmonious, integrated plan which justifies exceptions to the normal requirements of this Ordinance; 5. Reflects an economical and efficient pattern of land uses; 6. Includes greater provisions for landscaping and open space than would generally be required; 7. utilizes aesthetic design principles to create attractive buildings and open areas which blend with the character of surrounding areas; 8. Does not create traffic congestion, noise, odor, or other adverse effects on surrounding areas that cannot be mitigated; and 9. Provides adequate access, parking, landscaping, trash areas and storage, as necessary. D. A copy of this study is on file at the City of Gilroy Planning Department, 7351 Rosanna street, Gilroy, California. FINDINGS & REASONS: The Initial study identified potentially significant effects on the environment. However, the applicant has agreed to specific revisions in the project and/or the project has been revised. See the following list of MITIGATION MEASURES, which avoid or mitigate potential effects to a point where no significant effects will occur. There is no substantial evidence that the project, as revised, may have a significant effect on the environment. The following reasons will support these findings: A. The proposed commercial planned Unit Development is consistent with the City'S General plan land use map; B. The proposed planned Unit Development is substantially consistent with the adopted goals and policies of the City'S General Plan document; C. The granting of the Planned Unit Development request will not adversely affect or impact adjacent parcels of land or developed commercial and residential properties in the vicinity; and D. The potential significant effects identified within the Initial Study can be mitigated to reduce them to an insignificant level of impact. EXHiBIT 8 Negative I DeClaratio~S 92-26 2 , 03/24/93 MITIGATION MEASURES: 1. prior to building permit issuance, the developer" shall submit a preliminary soils investigation report prepared by a geotechnical firm specializing in foundation and soils analysis. The recommendations of the preliminary soils investigation shall be incorporated into the final improvement plans, subject to the review and approval by the city's Building and Public Works Departments. 2. Prior to the development of the site, the developer shall pay the required City-wide Traffic Impact Fee, subject to the review and approval by the city Department of Public Works. 3. The design of all street improvements serving the project site shall be provided by the developer, subject to the review and approval by the City Department of Public Works. These improvements shall include, but not limited to, sufficient right-of-way for a second southbound left-turn lane on Santa Teresa Boulevard to First street. 4. This signal, if warranted, shall be constructed by the developer in Phase II. 6. Proposed street improvements shall include the relocation of the existing Santa Clara County Transit bus turnout adjacent to the project site, subject to the review and approval by Santa Clara County Transportation and the City of Gilroy public works Department. 7. Facilities encouraging bicycle use shall be provided, subject to the review and approval by the city Planning Department. 8. The developer shall construct all utilities to, through, and on the site underground, subject to the review and approval by the city Department of Public Works. 9. The recommended MITIGATION MEASURES #1 through #15 (with the recommended changes by the Public works Department noted within this staff report) shall be applied to the approval of the project in order to reduce and/or eliminate all potential significant impacts to a level of insignificance, as required under the California Environmental Quality Act (CEQA). 2. Landscaping: Landscaping plans including specifications for an irrigation system shall, be approved by the Planning Director in accordance with the city's Consolidated Landscaping Policy, prior. to issuance of a building permi t. The landscaping shall' be continuously maintained in an orderly I live, healthy, and relatively weed-free condition, in accordance with the adopted Landscaping policy and the approved specific landscape plan. 3. Proposed trash enclosures shall be relocated out of the front and street side yard setbacks. All trash enclosures shall consist of visually solid fences and gates, six feet in height, in accordance with the adopted City of Gilroy standard trash enclosure design ~_an, or a similar design approved by the Planning Director. All trash enclosures shall be located in accordance with the approved site plan and fire regulations. 44 Exterior Lighting: No unobstructed beam of exterior lighting shall be directed outward from the site toward any residential use or public right- of-way. 5. Mechanical Appurtenances: Mechanical equipment to be located on the roof of a building shall be screened by an architectural feature of the building such that i~ cannot be seen from ground level at the far side of the adjacent public right-of-way, whenever possible. 64 The developer/applicant must obtain a sewer allotment for this project, and sign a sewer allotment agreement prior to the issuance of any building permits. 7. The applicant/developer may be required to install on-site fire hydrants. Hydrant locations, looping, and water main sizing shall be subject to the review and approval by the Fire and public works Departments, and shall be subject to the following: A4 Materials used for these installations shall be identical to those required in the city of Gilroy standard Details for off-site installations. This includes pipe, valves, hydrants, back-flow prevention devices, concrete, trench back-fill, etc.; B. Pipes which serve as fire sprinkler services are subject to the specifications of the Gilroy Fire Department once they depart from the City main and anyon-site or off-site hydrant system and must have a City standard valve intervening; C. All driveway curb cuts shall be designed with a m~n~um width of thirty- five feet at the public right-of-way line, and shall be subject to the review and approval by the public works Department. 9. off-site street improvements on Kelton Drive, to include the location and width of all driveway curb cuts, shall be subject to the review and approval by the Public works Department. 10. Secondary access to Kelton Drive, via the existing sixty foot easement, shall be improved under Phase' I construction, subject to the review and approval by the Planning and Public works Departments. 11. All off-site street improvements on First street, including any median improvements and the location and width of all driveway curb cuts, shall be subject to the review and approval by the public works Department and the California Department of Transportation. 12. All anticipated street work within the right-of-way for First Street (state Highway 152) will require an encroachment permit from the california Department of Transportation and the city of Gilroy Department of public works. 13. All off-site street improvements on Santa Teresa Boulevard, including any median improvements and the location and width of all driveway curb cuts, shall be subject to the review and approval by the Public Works Department and the Santa clara county Transportation Agency. 14. The proposed curved driveway configuration immediately off First street is unacceptable. The proposed driveway shall be redesigned in manner that will accommodate property immediately to the east in a shared driveway approach. The ultimate design configuration shall be subject to the review and approval by the Planning and Public Works Departments. 15. Building colors shall be earth tones, subject to Planning Department review and approval. 16. The standard Architectural & site Review process, rather than the planned unit Development process, will be required for the future development of Phases II and III if the planning Director determines that the over_all architectural style and building materials are substantially consistent with the original Phase I design scheme. 17. Occupancy for all future businesses shall be limited by the amount of on- site parking stalls provided for the entire complex, as required under section 31 of the city's Zoning ordinance.
