RESOLUTION NO. 93- 36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING A/S 93-12, AN APPLICATION FOR ARCHITECTURAL AND SITE REVIEW OF A PLANNED UNIT DEVELOPMENT FOR CONSTRUCTION OF 65 SINGLE FAMILY RESIDENTIAL HOMES ON APPROXIMATELY 15.85 ACRES OF PROPERTY ZONED R1-PUD, LOCATED NEAR THE NORTHWESTERN CORNER OF LONGMEADOW DRIVE AND SANTA TERESA BOULEVARD, APNS 783-20-029, -028 (PARTIAL), AND 783-40-05 WHEREAS, Kaufman & Broad has submitted A/S 93 -12, an application for Architectural and site Plan Review of a Planned unit Development, for the purpose of constructing 65 single family residences on approximately 15.85 acres of property zoned R1-PUD, located near the northwestern corner of Longmeadow Drive and Santa Teresa Boulevard, APNs 783-20-029, -028 (partial), and 783-40-05, as such land is shown on the map attached hereto as Exhibit A and incorporated herein by this reference; and, WHEREAS, the City prepared and circulated and subse- quently duly approved on July 20, 1992, all in accordance with the California Environmental Quality Act ("CEQA"), a mitigated Negative Declaration, attached as Exhibit B and incorporated herein by this reference, for a project which encompasses this application; and WHEREAS, the Planning commission at its regular meeting on June 3, 1993, adopted Resolution No. 93-20 recommending that the city Council approve A/S 92-12, subject to nine conditions and any mitigation measures of the Negative Declaration. NOW, THEREFORE, BE IT RESOLVED THAT: A. The City Council finds that the City has properly taken all actions required by CEQA. B. A/S 92-12 should be and hereby is approved, subject to the mitigation measures contained in the mitigated Negative Declaration and mitigation monitoring program attached hereto and incorporated herein as Exhibit c, and subject to the nine condi- tions attached hereto and incorporated herein as Exhibit D, to RESOLUTION NO. 93 - 36 -1- . . allow construction of 65 single family residences on approximately 15.85 acres of property zoned R1-PUD, located near the northwestern corner of Longmeadow Drive and Santa Teresa Boulevard, APNs 783- 20-029, -028 (partial), and 783-40-05, as such land is shown in Exhibit A. The Initial study was independently reviewed by City staff, and this Negative I:B:laration reflects the independent judgement of the City of Gilroy. MITIG1\TION MID\SURES: L The developer shall, as s=n as possible, and before issuance of any building permits for the project, negotiate with the Gilroy unified Scheel District to determine the level of additional impacts on the District. In the case of an :i1npasse, the City of Gilroy shall mediate the negotiation. Following completion of the negotiations, the developer shall provide mitigation of the impacts to the Scheel District which may include 1) impact fees, 2) dedication of land, 3) facilities arxljor 4) equipment. 2. A water well destruction pennit shall be obtained from the Santa Clara valley Water District, and the well shall be sealed in a=rdance with District standards. 3. Special fC>U1'XJation systems consisting of I) drilled, poured-in-place concrete, friction piers and grade beams or 2) conventional strip foundation feet:in::Js with isolated interior friction piers; prerroisturization programs; the soil subgrade of the foundation trenches; and concrete slabs-on~de, as needed, shall be provided throughout the highly eJq?al1Sive clay soil area as detennined by the DeCember, 1986 soil and geologic investigation by Applied Soil Mechanics, Inc. 4. Drainage shall be =rrtrolled away from all structures and pavements. 5. A r:ortion of the compressible silts shall be removed, and the remaining underlying silts shaLL be densified with grading =npactors throughout the compressible silt soil area as determined by the December, 1986 soil and geologic investigation by Applied soil Mechanics, Inc. 6.
