RESOLUTION NO. 93- 36
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING A/S 93-12, AN APPLICATION
FOR ARCHITECTURAL AND SITE REVIEW OF A PLANNED
UNIT DEVELOPMENT FOR CONSTRUCTION OF 65 SINGLE
FAMILY RESIDENTIAL HOMES ON APPROXIMATELY
15.85 ACRES OF PROPERTY ZONED R1-PUD, LOCATED
NEAR THE NORTHWESTERN CORNER OF LONGMEADOW
DRIVE AND SANTA TERESA BOULEVARD, APNS
783-20-029, -028 (PARTIAL), AND 783-40-05
WHEREAS, Kaufman & Broad has submitted A/S 93 -12, an
application for Architectural and site Plan Review of a Planned
unit Development, for the purpose of constructing 65 single family
residences on approximately 15.85 acres of property zoned R1-PUD,
located near the northwestern corner of Longmeadow Drive and Santa
Teresa Boulevard, APNs 783-20-029, -028 (partial), and 783-40-05,
as such land is shown on the map attached hereto as Exhibit A and
incorporated herein by this reference; and,
WHEREAS, the City prepared and circulated and subse-
quently duly approved on July 20, 1992, all in accordance with the
California Environmental Quality Act ("CEQA"), a mitigated Negative
Declaration, attached as Exhibit B and incorporated herein by this
reference, for a project which encompasses this application; and
WHEREAS, the Planning commission at its regular meeting
on June 3, 1993, adopted Resolution No. 93-20 recommending that the
city Council approve A/S 92-12, subject to nine conditions and any
mitigation measures of the Negative Declaration.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council finds that the City has properly
taken all actions required by CEQA.
B. A/S 92-12 should be and hereby is approved, subject
to the mitigation measures contained in the mitigated Negative
Declaration and mitigation monitoring program attached hereto and
incorporated herein as Exhibit c, and subject to the nine condi-
tions attached hereto and incorporated herein as Exhibit D, to

INITIAL STUDY:
An Expanded Initial Study of this project was undertaken and prepared for
the p.rq:ose of ascertaining whether this project might have a significant
effect on the environment. A copy of this study is on file at the City of
Gilroy Planning D2partment, 7351 Rosanna StrPet, Gilroy, CA 95020.
FINDINGS I< REASONS:
The Initial study identified p:ltentially significant effects on the
environment. However, the project has been mitigated (see Mitigation
Measures below which avoid or mitigate the effects) to a p:lint where no
significant effects will ==. There is no substantial evidence the
project may have a significant effect on the envL.'Unment. The following
reasons will support these findings:
1. The proposal is a lo:;ical extension of the existing urban, land use,
and zoning patterns of this area.
2. Identified adverse impacts suc.'1 as the effect on school impacts and
increase in traffic generated from this project are prop:lsed to be
mitigated throjJgh school impaction fees, and const..-ruction of off-site

3. The proposed project is consistent with the adopted goals and r:olicies
of the General Plan of the City of Gilroy.
4. The Initial study was independently reviewed by City staff, and this
Negative I:B:laration reflects the independent judgement of the City of
Gilroy.
MITIG1\TION MID\SURES:
L The developer shall, as s=n as possible, and before issuance of any
building permits for the project, negotiate with the Gilroy unified Scheel
District to determine the level of additional impacts on the District. In
the case of an :i1npasse, the City of Gilroy shall mediate the negotiation.
Following completion of the negotiations, the developer shall provide
mitigation of the impacts to the Scheel District which may include 1)
impact fees, 2) dedication of land, 3) facilities arxljor 4) equipment.
2. A water well destruction pennit shall be obtained from the Santa Clara
valley Water District, and the well shall be sealed in a=rdance with
District standards.
3. Special fC>U1'XJation systems consisting of I) drilled, poured-in-place
concrete, friction piers and grade beams or 2) conventional strip
foundation feet:in::Js with isolated interior friction piers;
prerroisturization programs; the soil subgrade of the foundation trenches;
and concrete slabs-on~de, as needed, shall be provided throughout the
highly eJq?al1Sive clay soil area as detennined by the DeCember, 1986 soil
and geologic investigation by Applied Soil Mechanics, Inc.
4. Drainage shall be =rrtrolled away from all structures and pavements.
5. A r:ortion of the compressible silts shall be removed, and the remaining
underlying silts shaLL be densified with grading =npactors throughout the
compressible silt soil area as determined by the December, 1986 soil and
geologic investigation by Applied soil Mechanics, Inc.
6. The proj ect shall be designed and constructed to incorp:>rate wall bracing,
mudsil anchors, tie downs, arxljor hinge connectors to ensure structural
stability as required by trle earthquake design regulations of the Uniform
Building Cede.
7. Street trees shall be planted throughout the project.
8. Landscaping shall be planted by future hornecw.ners.
9. Landscaping shall be installed to enhance thE< sound walls along Santa
Teresa Eoulevard and LDngmeadow Drive in a=rdance with the requirements
of the City's Consolidated landscaping Policy.
10. Building pads and homes shall be designed and construct:ed so that the
finished fleer is elevated or flocd-prcofed to or above w'c.e projected

=ntract provisions.

18. The onsite stann drainage system shall be =nstructed to accommoclate
storrnwater runoff from the existing drainage ditch at the ncrthwesterly
=rner of the site.
19. Required public safety llnpact: fees shall be paid in a=rdance with
established City policy.
20. A =ntribution shall be made toward the cost of a fire station location
study .
