RESOLUTION NO. 93-52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING AjS 93-15, AN APPLICATION
FOR ARCHITECTURAL AND SITE REVIEW OF A PLANNED
UNIT DEVELOPMENT FOR DEVELOPMENT OF PHASE IV
OF THE GILROY OUTLET CENTER, A COMMERCIAL
RETAIL COMPLEX, ON APPROXIMATELY 18 ACRES OF
PROPERTY LOCATED NORTH OF LEAVES LEY ROAD AND
EAST OF SAN YSIDRO AVENUE, APNS 835-04-017,
-041 AND -042.
WHEREAS, The Glen Loma Group has submitted AjS 93-15, an
application for Architectural and site Plan Review of a Planned
unit Development, for the purpose of developing Phase IV of the
Gilroy Outlet Center, a commercial retail complex, on approximately
18 acres of property located north of Leavesley Road and East of
San Ysidro Avenue, APNs 835-04-017, -041 and -042; and,
WHEREAS, the city prepared, circulated and certified in
accordance with the California Environmental Quality Act ("CEQA"),
an Environmental Impact Report ("EIR") for a project which
encompasses this application, and adopted a mitigation monitoring
program in conjunction therewith; and
WHEREAS, the Planning Commission at its regular meeting
on August 5, 1993, voted to recommend that the City Council approve
AjS 93-15, subject to eighteen conditions as set forth in the staff
report dated July 29, 1993 and Condition 19 set forth in the staff
report dated August 5, 1993, incorporated herein by this reference;
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The city Council finds that the City has properly
taken all actions required by CEQA.
B. The city Council further finds pursuant to Zoning
Ordinance section 50.55 that:
1. The proposed project conforms to the land use
designation for the property on the General Plan map, and is
consistent with the intent of the text of the General Plan
document;

2. Public utilities and infrastructure improve-
ments needed in order to serve the proposed project are in close
proximity; and
3. There will be no significant environmental
impacts as a result of this project due to the required mitigation
measures to be applied at the development stage.
c. A/S 93-15 should be and hereby is approved, subject
to the mitigation measures contained in the EIR, the nineteen
conditions recommended by the Planning Commission referenced above,
and adding thereto Condition 20, as follows:
Condition 20. The applicant acknowledges that
it is the owner of Phase III and Phase IV of
the Gilroy Outlet Center. The applicant shall
use its best efforts to initiate shuttle
service for customer use for Phases III and IV
in conjunction with Phases I and II, consi-
dering such service on a permanent basis or
during periods of expected high retail
activity in the Center. The applicant agrees
to share in costs of such service on a pro rata
basis with other Outlet Phases. This obliga-
tion shall be a continuing obligation of the
applicant, developer, and/or owner of Phases
III and IV, and the applicant agrees to bind
any successors-in-interest to this obligation.
