RESOLUTION NO. 93-60
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY UPHOLDING THE PLANNING COMMISSION'S
DECISION TO AFFIRM THE PLANNING DIRECTOR'S
DETERMINATION OF THE ZONING DESIGNATION FOR A
YOUTH CENTER
WHEREAS, the Planning Director of the city of Gilroy
determined the proposed Gilroy Community Youth Center is a
Community Center under Section 18.30 of the Zoning Ordinanc~ of the
ci ty of Gilroy, and is therefore a permitted use in the CM
(Commercial Industrial) zoning district; and,
WHEREAS, the Planning Director's determination of a
zoning designation is a ministerial action which is not subject to
the California Environmental Quality Act ("CEQA"); and,
WHEREAS, William and Sue James appealed the Planning
Director's determination of the Youth Center's zoning designation
to the Planning Commission; and,
WHEREAS, the Planning Commission, at their duly noticed
regular meeting on October 7, 1993, voted to affirm the Planning
Director's determination; and
WHEREAS, William and Sue James thereafter appealed the
Planning Commission's decision to the City Council; and,
WHEREAS, this City Council has held a duly noticed public
hearing on the matter on October 25, 1993, and accepted and
considered all oral and written testimony and staff reports.
NOW, THEREFORE, BE IT RESOLVED THAT:
This City Council hereby denies the appeal of William and
Sue James and upholds the Planning Commission's decision to affirm
the Planning Director's determination that the Gilroy Community
Youth Center is a Community Center under Section 18.30 of the

zoning Ordinance and is therefore a permitted use within the CM
(Commercial Industrial) District.
PASSED AND ADOPTED this 25th day of October, 1993 by the
following vote:
