RESOLUTION NO. 93-78
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY RESCINDING CITY COUNCIL RESOLUTION
NO. 93-2 WHICH STATED CITY INTENT TO BE
INCLUDED WITHIN THE JURISDICTION OF THE SANTA
CLARA COUNTY OPEN SPACE AUTHORITY
WHEREAS, the Santa Clara County Open Space Authority Act,
Public Resources Code sections 3500 et ~, has created the Santa
Clara County Open Space Authority, and provides that each city
within the Authority's maximum jurisdictional boundaries shall by
January 15, 1993, have passed a resolution stating its intent to
be included within the Authority's jurisdiction; and,
WHEREAS, this City Council did on January 4, 1993, adopt
Resolution No. 93-2, stating the City's intent to be included
within the Authority's jurisdiction; and,
WHEREAS, the question of whether to include the City
within the Authority's jurisdiction was referred to the voters of
the City as an advisory measure at the November 2, 1993 election;
and,
WHEREAS, a majority of the city's voters voted against
including the City within the Authority's jurisdiction; and,
WHEREAS, this Council has considered the results of that
election and has decided that, in accordance with the desires of
the voters of the City of Gilroy, this Council should rescind
Resolution No. 93-2 and the statement contained therein of the
city's intent to be included within the Authority's jurisdiction.
NOW, THEREFORE, BE IT RESOLVED THAT Resolution 93-2 and
the statement therein of the City's intent to be included within
the jurisdiction of the Santa Clara County Open Space Authority are
hereby rescinded. The City Clerk is hereby directed to deliver a

certified copy of this Resolution forthwith to the interim Board
of Directors of the Santa Clara County Open Space Authority.
