'1, . . .If o ~ RESOLUTION NO. 94-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY GRANTING AN APPEAL OF THE PLANNING COMMISSION'S DECISION AND THEREBY UPHOLDING A DECISION OF THE PLANNING DIRECTOR TO DENY AN EXEMPTION UNDER THE CITY'S RESIDENTIAL DEVELOPMENT ORDINANCE WHEREAS, Section 50.62(b) of the city of Gilroy Resi- dential Development Ordinance ("RDO") provides for exemptions from the development restrictions of that ordinance, one of which such exemptions is for projects containing four or fewer single family residential lots; and, WHEREAS, Section 50.62(b) (1) provides that such exemp- tions shall not apply to projects which, within any three year period, are combined with other projects otherwise exempt, where the parcels for the projects are contiguous and will result in development of greater than four dwelling units; and, WHEREAS, Albert Fortino applied for and obtained a lot line adjustment approval for the purpose of creating three conti- guous developable parcels; and, WHEREAS, Mr. Fortino subsequently applied for approval to subdivide each of these three parcels into five new parcels, such subdivision scheme as is indicated on the plan attached hereto as Exhibit A and incorporated herein by this reference; and, WHEREAS, Mr. Fortino's proposal was such that, of the five new parcels that would be created on each of the three parcels created by the lot line adjustment, four of the new parcels would be developed with single family residences (for a total of twelve single family residences), the other left as a designated remainder parcel and comprising an undeveloped separation between each group of four parcels; and, RESOLUTION NO. 94 - 2 -1- " ~ . . WHEREAS, the Planning Director of the city of Gilroy determined that the remainder parcels that Mr. Fortino proposed be located between each group of four new parcels did not extinguish the contiguous character of the three original parcels, that Mr. Fortino's proposal was in fact a proposal to subdivide three contiguous parcels resulting in greater than four dwelling units, thus disqualifying the proposal from an exemption under section 50.62(b) (1) of the RDO; and, WHEREAS, Mr. Fortino appealed the Planning Director's determination to the Planning Commission and; WHEREAS, the Planning Commission, at their duly noticed regular meeting of November 4, 1993, voted to grant Mr. Fortino's appeal; and, WHEREAS, thereafter the Planning Commission's decision was appealed to the city Council; and, WHEREAS, this City Council has held a duly noticed public hearing on the matter on December 20, 1993, at which hearing it accepted and considered oral and written testimony and staff reports. NOW, THEREFORE, BE IT RESOLVED THAT: This City Council hereby grants the appeal of the Planning Commission's decision and upholds the determination of the Planning Director that the remainder parcels proposed to be located between each group of four new parcels did not extinguish the contiguous character of the three original parcels, that Mr. Fortino's proposal is to subdivide three contiguous parcels resulting in greater than four dwelling units and that the proposal RESOLUTION NO. 94 - 2 -2- ~"'-.. - .
