RESOLUTION NO. 94 - 4 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AUTHORIZING THE CITY ADMINISTRATOR OR HIS DESIGNEE TO FILE AN APPLICATION FOR FEDERAL ENHANCEMENTS PROGRAM FUNDING FOR $103,000 TO REHABILITATE THE GILROY S.P.R.R. TRAIN DEPOT. THIS RESOLUTION COMMITS THE NECESSARY LOCAL MATCH FOR THE PROJECT AND ALSO STATES THE ASSURANCE OF THE CITY OF GILROY TO COMPLETE THE PROJECT. WHEREAS, the City of Gilroy has authority under California Government Code Sections 37350 et seq. for the exercise of certain powers to construct and maintain buildings for Municipal purposes, including buildings located in public transit corridors;and WHEREAS, the Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA) (Public Law 102-240, Dec. 18, 1991) created the Transportation Enhancements Activities (Enhancements) program as a part of the Surface Transportation Program (23 U.S.C. s 133); and WHEREAS, a portion of the Surface Transportation Program funds are set aside for the Enhancements program; and WHEREAS, pursuant to the ISTEA, and the regulations promulgated thereunder, eligible project sponsors wishing to receive Enhancement program grants for a project shall submit an application first with the appropriate metropolitan transportation planning organization, for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Transportation Commission is the MPO for the San Francisco Bay region; and WHEREAS, the City of Gilroy is an eligible project sponsor for Enhancements program funds; and WHEREAS, the City of Gilroy wishes to submit a grant application to MTC for funds from the Enhancements program in fiscal year 1994/1995 for the following project: -1- RESOLLUTION NO. 94 - 4 ~ . . Reparation and restoration of the Gilroy S.P.R.R. train depot located at 7250 Monterey street. This project will involve renovation of the structure to bring it into compliance with ADA standards and the UBC, removal of asbestos, and restoration of the interior and exterior of the building. The total project cost is estimated to be $202,000, with $103,000 requested from the ISTEA program. WHEREAS, MTC requires, as part of the application, a resolution stating the following: 1) The commitment of necessary local matching funds (at least 20% for bicycle and pedestrian projects, arid at least 11.5% for all other projects); and 2) That the sponsor understands that the Enhancements program funding is fixed at the programmed amount, and therefore any cost increase cannot be expected tc be funded with Enhancements program funds; and 3) The assurance of the sponsor to complete the project as described in the application, anI if approved as programmed in MTC's TIP. NOW THEREFORE BE IT RESOLVED by the City Council of the city of Gilroy that the City Administrator or his designee is authorized to execute and file an application for funding under the Enhancements program of the ISTEA in the amount of $103,000 for the rehabilitation of the Gilroy S.P.R.R. train depot; and BE IT FURTHER RESOLVED, that the City of Gilroy by adopting this resolution does hereby state that: 1) The City of Gilroy will provide $15,000 (12.7%) in local matching funds; and 2) The City of Gilroy understands that the Enhancements program funding for the project is fixed at $103,000, and that any cost increases must be funded by the City of Gilroy from local matching funds, and that the City of Gilroy does not expect any cost increases to be funded with Enhancements funds; and 3) The City of Gilroy will be built as described in this resolution and, if approved, as programmed in Metropolitan Transportation Commission (MTC) Transportation Improvement Program (TIP). BE IT FURTHER RESOLVED, that a copy of this resolution will be transmitted to the MTC in conjunction with the filing of the application; and -2- RESOLUTION NO. 94 - 4 . . BE IT FURTHER RESOLVED, that the MTC is requested to support the application for the project described in the resolution and to program the project, if approved, in the MTC's TIP.
