Resolution 1994-13 . . RESOLUTION NO. 94-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING THE UNIFORM FIRE CODE, 1991 EDITION, ADDING APPENDIX II-F AS AMENDED WHEREAS, section 10.9 of the Gilroy City Code provides that the latest edition of the Uniform Fire Code shall be submitted to the City Council to become effective within the City of Gilroy upon approval by resolution, subject to possible modifications and amendments; and WHEREAS, the City Council adopted the 1991 edition of the Uniform Fire Code on June 1, 1992 by Resolution No. 92-40; and WHEREAS, the following amendment to the Uniform Fire Code, 1991 edition, adding Appendix II-F as amended, attached hereto as Exhibit "A" and incorporated herein by this reference, has been submitted and recommended by the Fire Chief for Council approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GILROY THAT: 1. The Uniform Fire Code, 1991 edition, Appendix II- F as amended - "Protected Aboveground Tanks for Motor Vehicle Fuel- Dispensing stations outside Buildings," set forth in Exhibit "A" is hereby adopted. 2. Any fees or charges set forth therein are hereby adopted. 3. The City Clerk is directed to forward copies of this Resolution to the Fire Chief so that interested persons may determine the amendments and modifications to the Uniform Fire Code applicable in the City of Gilroy. SCOPE Storage and dispensing of rrotor fuels into the fuel tanks of rrotor vehicles fran protected aboveground tanks located outside buildings shall be in accordance with this appendix. 2. DEFINITI<H; For the purpose of this appendix, certain tenns are defined as follows: FUEL DELIVERY SYS'JD( is a system which consists of a tank vehicle containing a pump, fill hose with appropriate connections, and a person who perfonns the tank filling operation of transferring fuel fran the tank vehicle to an aboveground tank. The b.1o types of fuel delivery systems for aboveground tanks are as follows: (a) ~J.1!iIJ FIF.YTRI'R HOSE SYSTDI is a fuel delivery system containing a reel-rrounted preconnected flexible hose having a maximum naninal d.ianeter of 2 inches and a manually controlled fuel delivery nozzle at the d.cMnstream end of the hose. (b) RIGID HOSE SYSTDI is a fuel delivery system utilizing one or rrore sections of large d.ianeter rigid hose (usually 3 to 4 inches in nanina1 d.ianeter) which does not contain a nozzle but which contains interlocking connections for manually connecting the hose fran the tank vehicle to the tank. PRIMARY TANK is a listed aboveground atm:>spheric tank used to store liquid. See definition of "primary contallnnent" in Section 9.118. PROJB.,"J.1!iIJ ~ TANK is a listed tank system consisting of a primary tank provided with protection fran physical damage, and fire-resistive protection fran a high-intensity liquid pool fire exposure. The tank system may provide these protection elemants as a unit or may be an assercbly of canponents, or a canbination thereof. 3. PERMITS AND PlANS A permit is required to install, operate, repair or m:x:lify protected aboveground tanks used for storage and dispensing of flanmable or canbustihle liquid rrotor fuels. Installation plans shall be su1:mi.tted with permit applications. The plans shall include the design, details, and specifications of the following: (a) Quantities and types of liquids to be stored. (b) Distances fran tanks and dispensers to property lines and buildings; Page 2 Aboveground Storage Tanks . . (c) Vehicle access; (d) Fire appliances; (e) Vehicle inpact protection; (f) Protected aboveground tanks and their support; (g) Method of storage and dispensing; (h) Overfill prevention, spill contaimnent, vents, vapor recovery, dispensers, and other equipteIlt and accessories including "breakaway" provisions; (i) Seismic design in accordance with the Building Code; (j) Secondary contaimnent; (k) Venting; (1) Piping; (m) Electrical systems; (n) Energency controls; and (0) Other infonnation as required by the Fire Chief. 4. TANK DESIGN (a) Protected aboveground tanks shall be listed and neet the requirem:mts of U.F.C. Standard No. 79-7. (b) Primary Tanks. prinaIy tanks shall be designed in accordance with Article 79, Division V. (c) Size. prinaIy tanks shall not exceed a 2000 gallon individual or 6000 gallon aggregate capacity. (d) Vents. 1. Capacity. The vent capacity reduction factor as provided in Section 79.509(b)4 shall not be alla.vecl. 2. Flame an:esters. Approved flane arresters shall be installed in nonnaJ. vents. 5. WCATICR; 1. Installations shall be limited to: (a) Farming/Ranch operations (b) Fleet operations (c) EquipteIlt rental services (d) Autcm:>hile dealerships (e) Construction sites (f) Other similar uses (g) Property zoned for industry (h) Property zoned for manufacturing Page 3 Aboveground Storage Tanks . . 2. Installations cu:e not approved for: (a) /my residential area or property zoned for residential use. (b) /my professional office area or property zoned for professional office use (c) /my Neighborhood CarlIercial area or property zoned for Neighborhood CarlIercial (d) /my Central District CarlIercial area or property zoned Central District CarlIercial (e) Any Shopping Center CarlIercial area or property zoned Shopping Center Camercial (f) Any Highway CarlIercial area or property zoned Highway CarlIercial Where there appears to be a conflict between 5-1 and 5-2, the Fire Chief shall detennine the applicable section. The decision of the Fire Chief is subject to appeal. 6. INSTALIATICIf (Ii' TANKS The installation of protected aboveground tanks shall be in accordance with the follCMing: (a) Separation Distances. A protected aboveground tank shall be separated by not less than: 1. Fifteen feet fran any property line of property which is or can be built up::>n, including the opposite side of a public way. 2. Five feet fran the nearest side of any public way or fran the nearest inportant building on the same property; and 3. Three feet fran adjacent tanks. (b) Total Quantity. Protected aboveground tank installations shall not exceed 6000 gallons aggregate capacity of primary tanks. Tank installations having the :maxi.mJm allCMable aggregate capacity shall be separated fran other installations of protected aboveground tanks by not less than 100 feet. (c) ~";:!I'Y Cont;:!l~nmAnt. Protected aboveground tanks shall be provided with drainage or diking in accordance with Section 79.115 and 79.507 or secondaIy containnent, a cooponent of the listed protected tank system. SecondaIy conta.i.rment shall be IIDnitored either visually or autanatically. Enclosed secondaIy containnent systems shall be provided with emergency venting. Page 4 Aboveground Storage Tanks . . (d) Vehicle IDplct Prot:ecti.co. Guard posts or other approved barrier protection shall be separately provided for each protected aboveground tank and for connected piping subject to vehicle inpact. The design of guard posts shall be in accordance with Section 80.301(w). (e) Overfill Prevention. Protected aboveground tanks shall not be filled in excess of 90% of their capacity. An overfill prevention system shall be provided for each tank. lA1ring tank filling operation, the system shall: 1. Provide an independent neans of notifying the person filling the tank that the fluid level has reached 85% of tank capacity. This may be accarplished by any one of the following: A. An alann providing an audible or visual signal. B. A tank level gauge marked at 85% of tank capacity. c. Other approved neans. 2. Autanatically shut off the flow of fuel to the tank when the quantity of liquid in the tank reaches 90% of tank capacity. For rigid hose fuel-delivery systems, an approved neans shall be provided to errpty the fill hose into the tank after the autanatic shutoff device is activated. 3. A pentaIlent sign shall be provided at the fill point for the tank documenting the filling procedure and the tank calibration chart. The filling procedure shall require the person filling the tank to detenni.ne the gallonage required to fill it to 90% of capacity before camencing the filling operation. (f) Fill Pipe Connections. The fill pipe shall be provided with a neans for making a direct connection to the tank vehicle 's fuel delivery hose so that the delivery of fuel is not exposed to the open air during the filling operation. When any portion of the fill pipe exterior to the tank extends below the level of the top of the tank, a check valve shall be installed in the fill pipe not IIDre than 12 inches fran the fill hose connection. See Section 79.508 for tank valves. Page 5 Aboveground Storage Tanks . . . , . . (g) Spill Cant;.; nArs. A spill container having a capacity of not less than 5 gallons shall be provided for each fill connection. For tanks with a top fill connection, spill containers shall be noncanbustible and shall be fixed to the tank and equipped with a manual drain valve which drains into the prilnar.y tank. For tanks with a renote fill connection, a portable spill container shall be provided. (h) Signs. warning signs and identification signs shall be installed to clearly identify hazards. The design of such signs shall be in accordance with Sections 79.109, 79.110, 79.807(e) and 79.903(d). Conspicuous signs prohibiting sinultaneous tank filling and fuel dispensing shall be posted. 7. INSTAUATICIf OF DISPENSnG AND PIPnG S!S.&:J!.16 Dispensing and piping systems and electrical controls shall be installed in accordance with Article 79, Divisions VII and IX, except as follows: (a) Tank Openings. Tank openings in protected aboveground tanks shall be through the top only. (b) Dispensing Devices. Dispensing devices are allaved to be installed imnedi.ately adjacent or on top of protected ab0ve- ground tanks. (c) AntisiphaD Devices. Approved antisiphon devices shall be installed in each external pipe connected to the tank when the pipe extends belCM the level of the top of the tank. 8. PARIOJ<<; OF TANK VEHIClBS Tank vehicles shall not be parked within 25 feet of a protected aboveground tank. E:XCE:P.rICIf: When the tank is being filled fran the tank vehicle. 9. MAIlf.l'ENANCE Protected aboveground tanks, piping and dispensing systems shall be maintained in a safe operating condition. Protected aboveground tanks and carponents of dispensing systems shall be maintained in accordance with their listings. Damage to protected aboveground tanks shall be repaired using materials having equal or greater strength and fire resistance. Page 6 Aboveground Storage Tanks . . . , . ,t .. , . . 10. FEES (a) Unifonn Fire Code pennit fee shall be consistent with the City of Gilroy's Carprehensive Fee Schedule. (b) A one-tine surcharge of $1000.00 shall be due and payable at the tine of initial pennit issuance. (c) Beginning with the adoption of the City's 1994 Carprehensive Fee Schedule, the one-tine surcharge shall be as provided for by the fee schedule. (d) The surcharge shall be applied to the business address. (e) The surcharge shall be used for the purchase of specialized fire suppression equiprent, spill containnent equiprent andother related support supplies and equiprent. km/b/ufc .. . 10 ... . .
