RESOLUTION NO. 94 - 19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ORDERING THE REORGANIZATION OF APPROXIMATELY 10.25 ACRES OF LAND EAST OF SANTA TERESA BOULEVARD AND NORTH OF THE FUTURE LONGMEADOW DRIVE EXTENSION, FOR ANNEXATION TO THE CITY OF GILROY AND DETACHMENT FROM THE SOUTH SANTA CLARA COUNTY FIRE DISTRICT (SANTA TERESA REORGANIZATION 93-01) WHEREAS, pursuant to part 1 of Title 5, Division 3, commencing with section 56000 of the California Government Code, petitioner Nowack and Associates, Incorporated has petitioned for annexation to the City of Gilroy approximately 10.25 acres of land on the east side of Santa Teresa Boulevard, north of the future Longmeadow Drive extension, consisting of one parcel numbered APN 790-05-039, known as Santa Teresa Boulevard Reorganization 93-01 and described in the legal description and shown on the map attached hereto as Exhibit "A" and incorporated herein by this reference; and WHEREAS, the owners of all affected parcels have consented to the annexation, as demonstrated by the document attached hereto as Exhibit "B" and incorporated herein by this reference; and WHEREAS, the reason for this reorganization is that the affected lands are contiguous to the City of Gilroy, making annexation a logical extension of City limits to lands whose use and development the City should control and detachment a logical transfer of fire services from a county entity to the City; and WHEREAS, this proposal is consistent with the Sphere of Influence of Gilroy; and WHEREAS, the regular county assessment roll will be used for taxes and assessments in the lands to be annexed; and -1- RESOLUTION NO. 94 - 19 . . WHEREAS, on February 3, 1992 the City Council duly approved a Negative Declaration in connection with an amendment to the City of Gilroy's General Plan redesignating the subject parcel to Low Density Residential, pursuant to the California Environmental Quality Act; and WHEREAS, the lands proposed to be annexed are unincorporated territory within Santa Clara County which is within the Urban Service Area of the City of Gilroy so that, pursuant to Government Code Section 56826, the Santa Clara County Local Agency Formation Commission (LAFCO) shall not review this reorganization, and the City Council is the conducting authority for the reorganization; and WHEREAS, the consent of all owners of land within the affected territory makes notice and a public hearing unnecessary prior to completing the reorganization; NOW THEREFORE BE IT RESOLVED that the City Council of the city of Gilroy hereby finds as follows: A. That this reorganization includes the annexation to the city of unincorporated territory within the Urban Service Area of the City as adopted by LAFCO; and B. That the County Surveyor has determined the boundaries of the proposal to be definite and certain, and in compliance with the road annexation policies of the commission; and C. That the proposal does not split lines of assessment or ownership; and D. That the proposal does not create islands or areas in which it would be difficult to provide municipal services; and E. That the proposal is consistent with the adopted General Plan of the City; and F. That the territory is contiguous to existing City limits; and -2- RESOLUTION NO. 94 - 19 . . G. That the City has complied with all conditions imposed by LAFCO for inclusion of the territory in the Urban Service Area of the City; and BE IT FURTHER RESOLVED THAT the lands described herein are hereby ordered to be annexed to the City of Gilroy and detached from the South Santa Clara County Fire District; and BE IT FURTHER RESOLVED THAT the City Clerk shall submit forthwith a certified copy of this resolution and the fees required by Government Code Section 54902.5, collected from the lead petitioner, to the executive officer of the Santa Clara County Local Agency Formation Commission. "EXHIBIT A" Annexation to City of Gilroy Santa Teresa Boulevard Reorganization No. 93-01 November 16, 1993 All that real property situate in the County of Santa Clara, State of California being a portion of Lot 10 and Lot 11 of that certain map entitled " Map of Thomas Rea Company Subdivision of Lot 10 of the James Murphy Subdivision of part of the Ro San Francisco de los Llagas and Lot 28 of the Las Animas Rancho, Santa Clara County, California 1910" recorded in Book N of Maps, at page 20, Santa Clara County Records, and being more particularly described as follows: BEGINNING at an angle point in the City Limits Line as established by "Northwest Annexation 65-1", said point being the northwest corner of that certain 27.06 acre parcel described in Book 3488 of Official Records, at page 518, Santa Clara County Records, thence from said POINT OF BEGINNING, along the original centerline of Santa Teresa Boulevard (formerly Morey Avenue), North 4050'00" East 959.77 feet to the southerly line of the City Limits Line as established by Sunrise Drive Reorganization 86-3; thence along said southerly line, south 89050' 00" East 55.18 feet to the easterly line of Santa Teresa Boulevard; thence along said easterly line, south 4050'00" West 577.10 feet to the northerly line of the Lands of Lenihan, as said lands are described in Book 0129 of Official Records, at page 317, Santa Clara County Records; thence along said northerly line, south 89050'00" East 1017.10 feet to the northwest corner of the Lands of Santa Clara Valley Water District as described in Book 0129 of Official Records, at page 314, Santa Clara County Records; thence along the easterly line of said Lands of Santa Clara Valley Water District, in part, and along Lands of Santa Clara Valley Water District as described in Book K144 of Official Records, at page 1233, Santa Clara County Records, in part, South 0008'00" West 381.40 feet to the City Limits Line of Gilroy as established by "Northwest Annexation 65-1"; thence along said City Limits Line, North 89050'00 West 1103.64 feet to the said point of beginning of this description, containing 10.25 acres of land, more or less. . .
