Resolution 1994-27 . . . RESOLUTION NO. 94-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING GPA 94-01, AMENDING THE GENERAL PLAN MAP FROM LOCAL COMMERCIAL AND LOW DENSITY RESIDENTIAL TO PARK/PUBLIC FACILITY ON APPROXIMATELY 1.35 ACRES ON FIVE PARCELS LOCATED NEAR THE INTERSECTION OF CHURCH AND FIFTH STREETS, APN'S 799-07-23, 799-06-31, 799-07-82, 799-07-01 AND 799-07-02. WHEREAS, the City of Gilroy has initiated a General Plan Amendment, GPA 94-01, to amend the General Plan Map from the designations of Local Commercial and Low Density Residential to Park/Public Facility on approximately 1.35 acres on five parcels located near the intersection of Church and Fifth streets, APN'S 799-07-23, 799-06-31, 799-07-82, 799-07-01 AND 799-07-02, as such land is shown on the map attached hereto as Exhibit A and incorporated herein by this reference; and, WHEREAS, the properties affected are contained within an area designated as an Historic Neighborhood and an Historic site Overlay; and, WHEREAS, upon the properties are found the following structures of significant public historic interest: the willey Cultural Center (commonly known as the "Willey House", or formerly, the "Theater Angels House"), which structure is and will continue to be used for park uses; the Gilroy Museum (formerly, the "Carnegie Library"); the Lirio Del Valle Church (formerly "Christian Church"); and the Salvation Army Building (formerly Gilroy Presbyterian Church); and, WHEREAS, approval of this project is categorically exempt from the environmental review requirements of the California Environmental Quality Act ("CEQA"), Public Resources Code Section 21000 et seq., as a Minor Alteration in Land Use Limitations within the meaning of CEQA Guidelines section 15305; and, WHEREAS, the Planning Commission held a duly noticed public hearing on GPA 94-01 on March 21, 1994 and subsequently RESOLUTION NO. 94 - 27 -1- . . voted to recommend that the City Council approve GPA 94-01; and, WHEREAS, the City Council held a duly noticed public hearing on GPA 94-01 on March 21, 1994. NOW, THEREFORE, BE IT RESOLVED THAT: A. The City has taken all actions required of it under the California Environmental Quality Act. B. This City Council hereby finds that approval of GPA 94-01 is in the public interest. C. GPA 94-01 is hereby approved, and the Gilroy General Plan Map is hereby amended to redesignate property from the General Plan Map designations of Local Commercial and Low Density Residential to Park/Public Facility on approximately 1.35 acres on five parcels located near the intersection of Church and Fifth streets, APN'S 799-07-23, 799-06-31, 799-07-82, 799-07-01 AND 799- 07-02, as such land is shown in Exhibit A.
