RESOLUTION NO. 94-31
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY DENYING GPA 91-01, A PROPOSAL TO
CHANGE THE DESIGNATION ON THE GENERAL PLAN MAP
FROM MEDIUM DENSITY RESIDENTIAL TO GENERAL
SERVICES COMMERCIAL, ON AN APPROXIMATELY 12.75
ACRE PARCEL OF LAND LOCATED AT THE SOUTHWEST
CORNER OF SANTA THERESA BOULEVARD AND HECKER
PASS HIGHWAY, APN NO. 810-21-06, AND WHICH
ALSO PROPOSED TO AMEND THE CITY GENERAL PLAN
ECONOMIC POLICY NOS. 12, 17, 18 AND 22
WHEREAS, DBO Development Company has submitted GPA 91-01,
which proposed to amend the General Plan Map of the City of Gilroy
to change the designation and density from Medium Density Resi-
dential to General Services Commercial, on an approximately 12.75
Acre parcel of land located at the Southwest corner of Santa
Theresa Boulevard and Hecker Pass Highway, APN No. 810-21-06, and
which also proposed to amend City General Plan Economic Policy Nos.
12, 17, 18 And 22; and,
WHEREAS, GPA 91-01 was reviewed and considered by the
Planning Commission at a duly noticed public meeting on the 6th
day of February, 1992, at which meeting the Planning Commission
voted to adopt Resolution No. 92-7, making certain findings and
recommending that the City Council deny GPA 91-01; and,
WHEREAS, this City Council, at its meeting of March 15,
1993, voted to certify an Environmental Impact Report for the
project; and,
WHEREAS, the City Council conducted a duly noticed public
hearing on the project on the 21st day of March, 1994, to consider
GPA 91-01 and determined that the project should be denied on the
basis that the project as proposed in that particular location
should not be approved; and,
WHEREAS, the Council moved to direct staff to prepare a
resolution denying GPA 91-01 and denying the proposed amendments
to General Plan Economic Policy Nos. 12, 17 and 22 by a vote of
five to two, Councilmembers Gage and Morales dissenting.

NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council hereby finds that the project
comprising GPA 91-01 as proposed at that particular location should
be denied on the grounds that it is not consistent with the intent
of the goals and policies in the General Plan.
B. GPA 91-01 and text amendments Economic Policy Nos.
12, 17 and 22 hereby are denied, and the General Plan Map of the
City of Gilroy is not amended as proposed therein or in any way.
