RESOLUTION NO. 94-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY DENYING Z 91-07, A REQUEST TO REZONE
FROM A-1 (AGRICULTURAL) TO C-3 (SHOPPING
CENTER COMMERCIAL) AN APPROXIMATELY 12. 75 ACRE
PARCEL OF LAND LOCATED AT THE SOUTHWEST CORNER
OF SANTA THERESA BOULEVARD AND HECKER PASS
HIGHWAY, APN NO. 810-21-06 -
WHEREAS, DBO Development Company ("Applicant") has
submitted Z 91-07, which proposed to rezone from A-1 (Agricultural)
to C-3 (Shopping Center Commercial) on an approximately 12.75 acre
parcel of land located at the Southwest corner of Santa Theresa
Boulevard and Hecker Pass Highway, APN No. 810-21-06; and,
WHEREAS, in conjunction with Z 91-07, Applicant also
submitted GPA 91-01, which proposed to amend the General Plan Map
of the City of Gilroy to change the designation and density of said
parcel from Medium Density Residential to General Services Commer-
cial, and which also proposed to amend City General Plan Economic
Policy Nos. 12, 17, 18 And 22; and,
WHEREAS, as set forth in the staff report on Z 91-07
dated January 1, 1992, a rezoning approving the Applicant's request
would be inconsistent with the General Plan if GPA 91-01 is denied;
and,
WHEREAS, at its regular meeting of March 21, 1994, the
Council moved to direct staff to prepare a resolution denying GPA
91-01 and denying the proposed amendments to General Plan Economic
Policy Nos. 12, 17 and 22 by a vote of five to two, Councilmembers
Gage and Morales dissenting.
NOW, THEREFORE, BE IT RESOLVED THAT:-
A. The City Council hereby finds that approving Z 91-
07 without having approved GPA 91-01 would be inconsistent with the
General Plan and therefore would not further the public necessity,
convenience and general welfare.

B. Z 91-07 hereby is denied.
