RESOLUTION NO. 94-35
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ABANDONING ITS INTENT TO LEVY AN
ANNUAL ASSESSMENT FOR THE DOWNTOWN GILROY
IMPROVEMENT AREA FOR THE 1994 FISCAL YEAR
WHEREAS, Ordinance No. 88-18 established the Downtown
Gilroy Business Improvement Area ("Area") pursuant to State law and
authorized the City of Gilroy to impose an assessment fee on
businesses within the Area; and
WHEREAS, Resolution No. 94-28 declared the City Council's
intention to levy an annual assessment for the Area for 1994 and
set a public hearing; and
WHEREAS, said public hearing was held on April 4, 1994
at 7:00 p.m. at Gilroy City Hall, 7351 Rosanna Street, Gilroy, CA
95020; and
WHEREAS, the public hearing on the levy of the 1994
annual assessment for the area has concluded.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Council finds that written protests were
received from the owners of businesses in the proposed Area which
will pay fifty percent or more of the assessments proposed to be
levied and the protests were not withdrawn prior to the conclusion
of the public hearing.
2. The City Council will take no further proceedings to levy
the proposed annual assessment as contained in the Resolution of
Intention, Resolution No. 94-28, for a period of one year from the
date of the finding of a majority protest by the City Council.
