RESOLUTION NO. 94 - 65
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ORDERING THE DEADLINE FOR ISSUING A
RATE ORDER REGARDING FALCON CABLE'S SUBMITTAL OF FCC FORM 1200.
WHEREAS, the City of Gilroy is certified to regulate basic cable rates
pursuant to the 1992 Cable Act ("the Act") and FCC rules; and
WHEREAS, the Falcon Cable has filed a proposed schedule of rates for the
basic service tier and associated equipment, hereafter "FCC Forms 1200 (and other
forms in 1200 series as required by FCC)", and the City of Gilroy must analyze said
forms and issue a rate order no later than 30 days after receiving the Forms 1200
from Falcon Cable; and
WHEREAS, the City is authorized pursuant to the Act and FCC rules to toll
the 30 day deadline for issuing a rate order for an additional 90 days.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Act and FCC rules, the
City Council of the City of Gilroy hereby orders that the deadline for issuing a
rate order be tolled for 90 days in order to allow additional time to review and
analyze Falcon Cable's submittal of FCC Form 1200.
PASSED AND ADOPTED this 6th day of September, 1994, by the following vote:
AYES: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROGERS, ROWLISON,
VALDEZ and GAGE.
