RESOLUTION NO. 94-81
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING THE UNIFORM FIRE CODE AND
UNIFORM BUILDING CODE AS RELATING TO AUTOMATIC
FIRE SPRINKLERS
WHEREAS, section 10.9 of the Gilroy city Code provides
that the latest edition of the Uniform Fire Code shall be submitted
to the City Council to become effective within the City of Gilroy
upon approval by resolution, subject to modifications and amend-
ments; and,
WHEREAS, section 6.1 of the Gilroy City Code provides
that the latest edition of the Uniform Building Code shall be
submitted to the City Council to become effective within the City
of Gilroy upon approval by resolution, subject to modifications and
amendments; and,
WHEREAS, the City Council adopted the 1991 edition of the
Uniform Fire Code on June 1, 1992 by Resolution No. 92-40; and,
WHEREAS, the City Council adopted the 1991 edition of the
Uniform Building Code on June 1, 1992, by Resolution No. 92-36;
and,
WHEREAS, based upon substantial evidence received both
orally and in writing, the city Council believes the public health,
safety and welfare will be furthered by an amendment to the City's
adoption of the Uniform Fire and Building Codes that requires that
an automatic fire sprinkler system shall be required for any new
building 3,000 square feet or greater in size.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GILROY THAT:
A. section 10.507 (b) of the Uniform Fire Code, 1991 edition,
as adopted and amended or modified by this city Council under
section 10.9 of the Gilroy City Code, and section 38.02(I) of the
Uniform Building Code, 1991 edition, as adopted and amended or

hereby certify that the attached Resolution No. 94-81 is an original
resolution, duly adopted by the Council of the City of Gilroy at a regular

modified by this City Council under section 6.2 of the Gilroy City
Code, are hereby amended to read as follows:
section 10.507 (b) - REQUIRED INSTALLATION OF AUTOMATIC FIRE
EXTINGUISHING SYSTEMS
In addition to the requirements of this code, an automatic
sprinkler system shall be installed as follows:
Any building or group of buildings where in the judgement of
the Fire Chief, such buildings or group of buildings due to
size, height, type of construction, location on property, or
contents of occupancy classification would exceed or severely
tax the capabilities of the local Fire Department to perform
a reasonable level of rescue and fire suppression.
Regardless of area or occupancy separation walls, an automatic
fire sprinkler system shall be required for any new building
3,000 square feet or greater. Such buildings shall include,m
but not be limited to:
(a) all buildings three stories or thirty feet in
height; or,
(b) buildings where limited access for fire apparatus
does not permit mobile unit operations of ladder
companies to within fifteen (15) feet of openings
in stories as required by the Uniform Building Code;
or,
(c) buildings where limited access for fire apparatus
does not permit mobile use of pump and hose
companies to reach all sides of the building without
laying more than 150 feet of fire hose.
(d) If a fire sprinkler system is not required for
purposes other than this section, the area
increases, the height and story increases and the
fire resistive substitution provided for in the
Uniform Building Code may be permitted.

(e) Additions to existing buildings: this section shall
apply to all additions to existing buildings.
1. If the entire building area including the
addi tion exceeds the area permitted by the
Uniform Building Code, then the entire building
shall be sprinklered; or,
2. If the entire building area, including the
addition, requires an automatic sprinkler
system by this section, but the entire building
is below the area specified in the Uniform
Building Code, the addition shall be equipped
with an automatic fire sprinkler system and be
separated from the existing building by an area
separation wall as specified in the Uniform
Building Code.
(f) Automatic fire sprinkler systems shall be installed
in all R-1 and R-3 buildings over five thousand
(5,000) square feet in area and all buildings
constructed in an RH (Residential Hillside) zoning
district.

3. The City Clerk is directed to forward copies of this
Resolution to the Fire Chief so that interested persons may
determine the amendments and modifications to the Uniform Fire Code
applicable in the City of Gilroy.
