RESOLUTION NO. 95 - 11
RESOLUTION INITIATING PROCEEDINGS
MAINTENANCE DISTRICT NO, 2,
CBY OF GILROY, COUNTY OF SANTA CLARA, CALIFORNIA
(pursuant to the Landscaping and Lighting Act of 1972)
The City Council of the City of Gilroy resolves:
L The City Council proposes to form an assessment district pursuant to the
Landscaping and Lighting Act of 1972 (Section 22500 and following, Streets and Highways
Code) for the purpose of the following improvements:
The maintenance and operation of and the furnishing of services and materials for
the soundwall and associated public landscaping improvements along the project
frontage on Thomas Road, the soundwall and associated landscaping improvements
along Santa Teresa Boulevard and the pedestrian pathway, public lighting facilities,
landscaping improvements, sign age, fencing and channel maintenance in and along
Babbs Creek, including the repair, removal or replacement of any of the
improvements, the cultivation, irrigation, trimming, spraying, fertilizing and treating
for disease or injury of all landscaping, the removal of trimmings, rubbish, debris
and other solid waste, the furnishing of electric current or energy, gas or other
illuminating agent for public lighting facilities and water for 'the irrigation of all
landscaping.
2. The proposed assessment district shall be designated Maintenance District
No.2, City of Gilroy, County of Santa Clara, California, and shall include the land shown
on the map designated "Assessment Diagram, Maintenance District No.2, City of Gilroy,
County of Santa Clara, CA.", which map is on file with the City Clerk and is hereby
approved.
3. Greiner, rne. is hereby designated engineer for the purpose of these
formation proceedings. The City Council hereby directs the engineer to prepare and file
with the City Clerk a report in accordance with Article 4 of Chapter 1 of the Landscaping
and Lighting Act of 1972.

I HEREBY CERTIFY THAT the foregoing resolution was duly and regularly
adopted and passed by the City Council of the City of Gilroy, California, at a regular
meeting thereof held on the 6th day of February, 1995, by the following vote of the
members thereof:
