RESOLUTION NO. 95-66
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY DECLARING ITS INTENT TO VACATE A
PORTION OF WELBURN AVENUE AS A PUBLIC STREET
WHEREAS, the City Council of the City of Gilroy finds
that a public works project incorporating Welburn Avenue is
necessary to comply with the provisions of the Gilroy Traffic
Circulation Plan and the General Plan; and
WHEREAS, the city Council of the City of Gilroy has
adopted resolutions of necessity and commenced condemnation
proceedings in Santa Clara Superior Court to take property
necessary to widen Welburn Avenue pursuant to the city's power of
eminent domain; and
WHEREAS, the city Council of the city of Gilroy finds
that the public works project to widen Welburn Avenue was
advertised for bid and that construction contract is to be awarded
on this date; and
WHEREAS, the city Council of the City of Gilroy finds
that the public works project to widen Welburn Avenue supersedes
and relocates the public street on the subject property referenced
herein; and
WHEREAS, the City Council of the city of Gilroy finds
that the relocation of Welburn Avenue and vacation of the subject
street portion will not cut off all access to any person's property
because all properties adjacent to the street to be vacated retain
points of ingress and egress from public thoroughfares; and
WHEREAS, the City Council of the city of Gilroy finds
that vacation of the sUbject street portion will not terminate any
public service easements; and
WHEREAS, the City Council of the City of Gilroy finds
that it owns the title to the street to be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

CITY OF GILROY as follows:
section I.
The City declares its intention to vacate a
portion of Welburn Avenue pursuant to sections 8330, 8335, and 8336
of the California streets and Highways Code.
section II.
The property to be vacated, a portion of the
public street named Welburn Avenue, is shown as Parcel W on the
map dated August, 1994, prepared by Hanna & Brunetti, which is
attached hereto as Exhibit A.
Parcel W is more particularly
described by the description which is attached hereto as Exhibit
B.
PASSED AND ADOPTED this 5th day of September, 1995 by
the following vote:
