RESOLUTION NO. 95-70
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ESTABLISHING A STANDARD MILEAGE
EXPENSE REIMBURSEMENT ALLOWANCE FOR CITY
EMPLOYEES.
WHEREAS, the Internal Revenue Code authorizes the IRS to
promulgate regulations and procedures regarding substantiation
requirements and allowable expenses per mile for business use of
an automobile and the Internal Revenue Service (IRS) has
promulgated such regulations and procedures; and
WHEREAS, Resolution No. 91-53 of the City of Gilroy
establishes a mileage expense reimbursement allowance pursuant to
said IRS regulations for City Councilmembers; and
WHEREAS, Resolution No. 91-53 sets a standard mileage
allowance for City councilmembers using personal automobiles for
official business at $0.275 per mile, but further directs that this
figure shall be automatically adjusted to correspond to the figures
set by the Commissioner of Internal Revenue as the Commissioner
promulgates Revenue Procedures from time to time under the
authority of the Internal Revenue Code; and
WHEREAS, in addition to City councilmembers, City
employees must regularly travel in their private automobiles to
conduct the city's official business and thereby incur expenses
which should be reimbursable in accordance with the IRS regulations
and procedures as said regulations are amended from time to time.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council
directs that the mileage expense reimbursement allowance set by the
commissioner of Internal Revenue from time to time under the
authority of the Internal Revenue Code and pursuant to IRS
regulations and procedures shall be reimbursable to all City
employees authorized to use personal automobiles while performing
official business of the City of Gilroy.
