RE$OLUTIONNO.96- 66
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING THE
APPLICATION FOR THE TRANSIT CAPITAL IMPROVEMENT PROGRAM
WHEREAS, the City of Gilroy desires to undertake a certain project designated: The
restoration and rehabilitation of the Gilroy S.P.RR. train depot to be funded from funds made
available through the Transit Capital Improvement Program administered by the State of
Califomia, and from a fifty percent match provided by City of Gilroy.
NOW THEREFORE BE IT RESOLVED that the City Administrator of the City of Gilroy
is authorized on its behalf to submit the attached proposal to the State of California and is
authorized to execute on behalf of the City Council any forthcoming Grant Award Agreement
including any extensions or amendments thereof
WHEREAS, the City has the financial and institutional ability to implement the project and
is empowered to let a contract; to sue or be sued by another entity or person;
IT IS AGREED, the Project will be available to the general public, and its primary
purpose will be to benefit the public. Any potential revenues realized to the City as a result of
IT IS ALSO AGREED that any liability arising out of the perfonnance of this Grant
leasing portions of the Depot Building to the private sector for the purposes of providing
transportation services or passenger amenities shall be used to offset maintenance of the building
and/or the site.
Award Agreement, including civil court actions for damages, shall be the responsibility of the
grant recipient and the authorizing agency.
BE IT RESOLVED that the matching funds required for this project are available and
when the CTC programs the City's TIC request, matching funds will be committed to this project.
IT IS ALSO AGREED that if the Project exceeds the state funds available, the City shall
use other funds to backfill the cost increases to complete the project or adjust the scope of the
project accordingly.
BE IT FURTHER RESOLVED that the City will comply with the Commissions' Timely
Use of Funds Policies.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to
supplant expenditures controller by this body.
