RESOLUTION NO. 97-19
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY REQUESTING AN
EXCHANGE OF FY 97/98 STATE TRANSIT CAPITAL IMPROVEMENT (TCI) PROGRAM
FUNDS FOR FY 94/95 STATE TCI FUNDS
WHEREAS, rehabilitating the SP Depot as an intermodal transportation facility is a City
Capital Improvement Project;
WHEREAS, the estimated total cost of the SP Depot Project is $922,000;
WHEREAS, the proposed Project financial plan is comprised of $42,000 FY 94/95 State
TCI funds, $103,000 FY 94/95 ISTEA TEA funds, and $351,000 FY 97/98 State TCI funds and
$426,000 local matching funds;
WHEREAS, the California Transportation Commission (CTC) is responsible for
programming and allocating State and Federal funds for the construction of transportation
projects;
WHEREAS, both Caltrans and the Metropolitan Transportation Commission are
recommending that the CTC program the City's request for $351,000 FY 97/98 TCI funds;
WHEREAS, the CTC is scheduled to adopt the FY 97/98 TCI Program on April 2-3,
1997;
WHEREAS, State statutes dictate that FY 94/95 State TCI funds be allocated by the
California Transportation Commission by June, 1997, or these funds revert to the State
Transportation Planning & Development Account;
WHEREAS, the City has submitted a request to the State that the $42,000 FY 94/95 TCI
funds and $103,000 FY 94/95 ISTEA TEA funds programmed for the SP Depot be allocated by
the CTC at their June, 1997 meeting;
WHEREAS, the City, by prior resolution, declared that local matching funds required for
". external funds have been committed, and when the CTC allocates the funds, matching funds will
be available for this projects;
"_ WHEREAS, Caltrans has advised the City that the State anticipates $221,000 FY 94/95
TCI Program residual funds which cannot be expended by another programmed recipient in the
time frames required by statute;
WHEREAS, the State is seeking a potential recipient who would be willing to accept
residual FY 94/95 TCI funds in exchange for other TCI funds programmed for their project;

WHEREAS, the City's project delivery schedule meets the statutory requirements for FY
94/95 State TCI funds;
WHEREAS, MTC staff has expressed a willingness to support such an exchange of funds
for the City's project;
NOW, THEREFORE, BE IT RESOLVED THAT the City is willing to accept an
exchange ofFY 97/98 State TCI funds for FY 94/95 State TCI funds with the understanding that
the City:
· must expend FY 94/95 TCI funds by June 30, 1999, and;
· will reduce its FY 97/98 request for State TCI funds by an amount equivalent to the
additional FY 94/95 TCI funds the City receives for the SP Depot Project.
BE IT FURTHER RESOLVED, in the event the CTC does not program FY 97/98 TCI
funds for this project, the City will:
· modifY the scope of the project to deliver a useable segment of the project using
programmed funds for this project, and;
· complete the project by submitting a request to the State for the balance of project funds
in a subsequent TCI funding cycle.
