RESOLUTION NO. 97-28
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY AUTHORIZING THE EXECUTION OF
PURCHASE AGREEMENTS FOR THE ACQUISITION OF
REAL PROPERTY (PORTIONS OF APN 808-21-011,
808-21-012 AND 808-21-020)
WHEREAS, City Staff has been negotiating for the
purchase of real property (the "Property") comprised of portions
of three parcels commonly known as Santa Clara County Assessor's
Parcel Numbers 808-21-011, APN 808-21-012 and APN 808-21-020i
WHEREAS, as a result of such negotiations, three
Agreements of Purchase and Sale, one for each of the three parcels
comprising the Property, have been prepared (the "Purchase
Agreements") containing terms and conditions acceptable to the
CitYi
WHEREAS, the City has determined that it is in the best
interest of the City to acquire the Property on the terms and
conditions set forth in the Purchase Agreementsi and
WHEREAS, acquisition of the Property pursuant to the
Purchase Agreements is exempt from the California Environmental
Quality Act ("CEQA") pursuant to CEQA Section 15316.
NOW,
THEREFORE,
BE
IT
RESOLVED
THAT
the
City
Administrator is hereby authorized to execute the Purchase
Agreements on behalf of the City and to bind the City theretoi and
City Staff is hereby authorized to file a notice of exemption from

to the provisions of CEQA.
