RESOLUTION NO. 97-29
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING A/S 97-05, AN APPLICATION
FOR ARCHITECTURAL AND SITE APPROVAL, APN 799-
19-010
WHEREAS, Brian and Carla Adams ("Applicants") submitted
A/S 97-05, an application for architectural and site approval for
plans to construct a 3,046 square foot addition to an existing
2,737 square foot dwelling located at 665 Fifth Street; and
WHEREAS, said property is zoned Single Family
Residential-Historic Site (R1-HS) and thereby any exterior
construction requires architectural and site approval from the
City Council due to the Historic designation pursuant to Sections
27.40 and 50.40 of the Zoning Ordinance; and
WHEREAS,
the California Environmental Quality Act
("CEQA") provides a categorical exemption which applies to this
request: Class 3, Section 15303; and
WHEREAS, the Historic Heritage Committee reviewed
application A/S 97-05 at its duly noticed meeting on April 9, 1997
and recommended that the City Council approve A/S 97-05; and
WHEREAS,
the Planning Commission reviewed application
A/S 97-05 at its duly noticed meeting on May 1, 1997 and
recommended that the City Council approve A/S 97-05 with four (4)
conditions as set forth in the staff report dated 4/8/97 (revised
5/13/97) which staff report is attached hereto as Exhibit A and
incorporated herein by this reference; and
WHEREAS, the City Council reviewed Application 97-05
and all documents relating thereto and took oral and written
testimony at its duly noticed meeting of May 19, 1997; and
WHEREAS, the location and custodian of the documents or
other materials which constitute the record of proceedings upon

which this project approval is based is the office of the City
Clerk;
NOW, THEREFORE, BE IT RESOLVED THAT
A. The City Council hereby finds:
1. The proposed proj ect is substantially consistent
with Zoning Ordinance Section 27.10 et seq. and there is no
evidence that the changes would jeopardize the building's
architectural or historical value.
2. The project is consistent with the Gilroy General
Plan because it conforms to the land use designation for the
property on the General Plan map, and it is substantially
consistent with the intent of the text, goals and policies of
the General Plan documents.
3. The project is categorically exempt from CEQA.
B. AjS 97-05 should be and hereby is approved subject to
the four (4) conditions set forth in the staff report attached
hereto as Exhibit A.

ANAL YSIS OF REOUEST:
The applicant is requesting Architectural & Site Review approval in order to construct a 3,046 square-foot addition
to an existing 2,737 square-foot single-family dwelling on property located at 665 Fifth Street, between Princevalle
and Carmel Streets. The existing residence is situated on a 24,156 square-foot lot. ,'The Historic Site (HS)
designation requires that the applicant submit plans for Architectural & Site Review before the Historical Heritage
Committee, the Planning Commission, and the City Council.
The subject property is an historic site of local significance, however, is not listed on any state or national historic
registries. Architectural features of the Tudor style dwelling include the following:
· Wood frame construction with cement plaster siding and curved, wooden batts;
· Decorative main entIy with brick terrace;
· Gabled and hipped roof design with decorative brackets and cedar shakes;
· Decorated gables with stickwork;
· Solarium with second-floor balcony on top;
· Wood-framed french windows; and
· Two brick chimneys with iron ties and braces.
If approved, new construction would more than double the size of the existing 2,737 square-foot dwelling. Zoning
Ordinance Section 27.40 does not limit the size of additions for historic sites, however, does require that requests
for remodeling historic sites be subject to the Architectural & Site Review process. If approved, the proposed new
addition will be indistinguishable from the existing residence. All new construction will incorporate the same exact
materials and architectural features of the original structure. Furthermore, the existing driveway will remain in its
current location, accessible off of the rear alley. The following key improvements are proposed:
1. New two-story addition with two-bedrooms, bath, and two-car garage;
2. New second-story addition with four new bedrooms, two bathrooms, storage, and the conversion of an
existing bedroom to an activity room;
3. New single-story addition with new family room, bedroom, elevator, laundry, and two bathrooms;
4. Additional front yard terrace and new rear yard terrace with brick wheelchair ramp; and
5. New chimney which matches existing chimneys.
As submitted, the proposed remodeling project will not negatively affect the character or appearance of the existing
historic site. This proposed project is consistent with, and meets the intent of, the City's Zoning Ordinance.
Although there are no required findings which have to be made in order to remodel an existing Historic Site, Staff
uses the Statement of Intent (Section 27.10 of the Zoning Ordinance) as a guideline to evaluate proposed projects.
The intent of the Historic Site and Neighborhood combining districts, as stated under Section 27.10, is as follows:
(a) To preserve historic sites and neighborhoods that represent important elements of Gilroy's past or
contribute to the community's identity or educational resources;
(b ) To enhance the visual character of Gilroy by encouraging and regulating the compatibility of architectural
styles within historic sites and neighborhoods;
(c) To identifY and designate areas which have a significant concentration or continuity of sites, buildings or
objects unified by past events or physical development; and

STAFF ACI10N:
Staff recommends approval of this project, with the finding that the proposed project is substantially
consistent with Zoning Ordinance Section 27.10, for the following reasons:
" '
(a) The expansion ofthis historical structure is consistent with the community's residential identity;
(b) This addition and expansion will further enhance the visual character of Gilroy;
(c) This addition will consist of the same architectural style and building materials feature.d on the existing
historic building;
(d) This addition is consistent with the historical character of the surrounding neighborhood; and
(e) The expansion of this historical site will be contained entirely within the allowable building envelope, in
accordance with the City's Zoning Ordinance.
In addition, Staff recommends that the following conditions be applied with approval of the project:
1. All materials and paint colors shall match those of the existing dwelling, subject to review and approval
by the Planning Division.
2. Residential automatic fire sprinklers shall be installed per NFPA 13D (required for all residential
structures 5,000 square feet or larger), subject to review and approval by the Building, Life, and
Environmental Safety Division.
3. The developer shall install smoke detectors to conform to the 1994 edition of the Uniform Building Code,
subject to review and approval by the Building, Life, and Environmental Safety Division.
4. Roof covering shall have a minimum fire rating of "Class C," subject to review and approval by the
Building, Life, and Environmental Safety Division.
mSTORIC HERITAGE COMMITTEE ACTION:
At their meeting of April 9, 1997, the Historic Heritage Committee voted unanimously to recommend that the City
Council approve A1S 97-05.
PLANNING COMMISSION ACTION:
At their meeting of May 1, 1997, the Planning Commission reaffirmed the action of the Historical Heritage
Committee and voted unanimously to recommend that the City Council approve A1S 97-05 with four conditions.
