Resolution 1997-43 . . RESOLUTION NO. 97-43 A RESOLUTION OF THE CITY COUNCIL OF GILROY ESTABLISHING VOLUNTARY CEILINGS FOR CANDIDATES AND COMMITTEES IN MUNICIPAL ELECTIONS OF THE CITY EXPENDITURE CONTROLLED WHEREAS, Proposition 208, the California Political Reform Act of 1996, is a statewide initiative measure passed by the voters at the November 5, 1996 election, which Proposition became effective on January 1, 1997; and WHEREAS, Proposition 208 amends the California Political Reform Act's provisions regarding political campaign finance and disclosure; and WHEREAS, Proposition 208 added Section 85400 entitled "Voluntary Expenditure Ceilings" to the Government Code enabling any local jurisdiction, municipality, or county to establish voluntary expenditure ceilings for candidates and controlled committees of such candidates for elective office not to exceed one dollar ($1) per resident for each election in the district in which the candidate is seeking elective office; and WHEREAS, candidates who voluntarily elect to comply with the expenditure ceiling established in any local jurisdiction, municipality or county are authorized by Proposition 208 to receive individual campaign contributions up to $250/election rather than the $100/election limit otherwise established by Proposition 208; and WHEREAS, under Proposition 208 candidates who voluntarily comply with any expenditure ceiling that may be established in this City shall be expressly acknowledged for such voluntary compliance on the election ballot; and WHEREAS, City Resolution No. 83-25 prohibits making any IRPJI345353,01 71-062604706002 -1- RESOLUTION NO. 97-43 . . campaign contribution in the City in aid of the nomination or election of a candidate which will cause the total amount contributed by such person with respect to a single election in support of such candidate to exceed Two Hundred Dollars ($200), which limit is less than the Two Hundred and Fifty Dollar ($250) contribution limit otherwise permitted under Proposition 208, the California Political Reform Act of 1996, for candidates who voluntarily comply with any expenditure ceiling established in this City. NOW, THEREFORE, BE IT RESOLVED THAT: 1. The City Council does hereby establish voluntary expenditure ceilings for candidates and controlled committees of such candidates for elective office not to exceed $0.35 per resident for each election in the City in which the candidate is seeking elective office. 2. Implementation of voluntary expenditure ceilings shall be in accordance with provisions of the California Political Reform Act of 1996. 3. Resolution No. 83-25 is hereby amended to increase the amount of authorized campaign contributions in the City so that it shall be prohibited to make any campaign contribution in the City in aid of the nomination or election of a candidate which will cause the total amount contributed by such person with respect to a single election in support of such candidate to II II II II II II II IRPJ1345353.01 71-062604706002 -2- RESOLUTION NO. 97-43 . . exceed Two Hundred and Fifty Dollars ($250).
