RESOLUTION NO. 97-45
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY CERTIFYING THE FINAL EIR FOR THE
GILROY MUNICIPAL GOLF COURSE PROJECT IN
ACCORDANCE WITH THE REQUIREMENTS OF THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, a Notice of Preparation for the Environmental
Impact Report ("EIR") for the Gilroy Municipal Golf Course
("Project") was prepared by the City of Gilroy ("City") as the
lead agency and was distributed on October 25, 1996 to appropriate
governmental agencies and interested persons, including the State
Clearinghouse; and
WHEREAS, the Notice of Preparation included a copy of
the initial study that had been prepared by City for the Project;
and
WHEREAS, during the Notice of Preparation review
period, City held public scoping meetings on November 14, 1996 and
on December 17, 1996 to discuss the characteristics of the
proposed project and the nature of the environmental effects and
scope of analysis to be included in the EIR, such meetings having
been attended by governmental agencies and neighborhood residents;
and
WHEREAS, an initial Draft EIR was completed and
circulated and made available for public review in March, 1997;
and
WHEREAS, it was determined that a revised draft EIR
should be prepared providing additional information concerning

project modifications and revised project impact and mitigation
measure discussions in response to comments received from the
property owner on the previously released Draft EIR; and
WHEREAS, a Revised Draft EIR was therefore prepared and
circulated and made available for public review beginning in April
1997 for a 45-day period; and
WHEREAS, written comments were received from
governmental agencies and from the general public on the Revised
Draft EIR and responses have been prepared to all such comments on
environmental issues received during the public review period,
which responses clarify and amplify the information contained in
the Draft EIR, providing good faith, reasoned analysis supported
by factual information; and
WHEREAS, a Final EIR was prepared consisting of three
volumes: Vol. I - Text of the Revised Draft Environmental Impact
Report dated April 1997; Vol. II - Technical Appendices dated
April 1997; and Vol. III - Response to Comments on Revised Draft
Environmental Impact Report dated June 1997, with appropriate
changes in the Revised Draft EIR in response to the comments
received, as well as setting forth all comments received and the
written responses thereto; and
WHEREAS, the Final EIR was presented to the Planning
Commission and was considered at a duly noticed public hearing on
June 26, 1997, following which the Planning Commission recommended
to the City Council that the Final EIR not be certified by City;
and

WHEREAS, the Final EIR was presented to the City
Council and was considered along with written and oral testimony
and staff reports at duly noticed public hearings on July 7, 1997
and July 28, 1997, and as a result of such testimony, the EIR
consultants and City staff clarified certain portions of the EIR
text and responses to comments; and
WHEREAS, the City Council held an additional duly
noticed public hearing on July 28, 1997 and considered all written
and oral testimony presented to it.
NOW, THEREFORE, BE IT RESOLVED:
(1) The City Council hereby certifies that the Final
EIR has been presented to it and has been reviewed and considered
by the Council, and that the Final EIR is complete, adequate and
in compliance with CEQA, and that it reflects the independent
judgment of the City as the lead agency; and
(2) The City Council designates the Director of
Community Development, at hislher office at 7351 Rosanna Street,

proceedings on which this certification is based.
