RESOLUTION NO. 97-48
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY TO AMEND THE CITY'S GENERAL PLAN TO
INCLUDE APPROXIMATELY 265 ACRES WITHIN THE
CITY'S GENERAL PLAN AREA AND THE CITY'S 20-
YEAR AREA BOUNDARY, APN 783-06-04, 05, 06,
07, 08, 09, 10; 783-13-03 (PORTION); GPA 97-
01
WHEREAS, the City of Gilroy ("Applicant") has submitted
GPA 97-01 requesting to amend the city's General Plan ("the
Project") to include approximately 265 acres within the city's
general plan area and its 20-year general plan area boundary; and
WHEREAS, the property affected by GPA 97-01 is located
north and east of Burchell Road, such land being more particularly
described as APN 783-06-04, 05, 06, 07, 08, 09, 10; a portion of
APN 783-13-03, which property is indicated on a map attached
hereto as Exhibit "A" and incorporated herein by reference; and
WHEREAS, a Final Environmental Impact Report ("Final
EIR") was prepared for this project (see also related applications
Z 97-02 and USA 97-01) and was certified in accordance with the
California Environmental Quality Act ("CEQA") by Resolution No.
97-45 by the City Council on July 28, 1997; and
WHEREAS, prior to any Project approvals, the City
Council adopted Resolution No. 97-47, making certain findings
concerning mitigation measures and alternatives,
adopting a
mitigation monitoring and reporting program, and adopting a
statement of overriding considerations in accordance with CEQA;
and
WHEREAS, the Planning Commission held a duly noticed
public hearing on GPA 97-01 on July 31, 1997, and after that
hearing voted to recommend approval of GPA 97-01; and
WHEREAS, the City Council held a duly noticed public
hearing on GPA 97-01 on July 31, 1997, at which public hearing the

City Council considered the Project and based upon substantial
evidence, including both oral and written testimony, resolved that
the Project should be approved with conditions; and
WHEREAS, the location and custodian of the documents or
other material which constitutes the record of proceedings upon
which this ordinance is based is the office of the City Clerk; and
WHEREAS, the proposed proj ect is generally consistent
with the policies of the City's General Plan text as stated more
fully in the Planning Division Staff Report for this Project dated
July 24, 1997.
NOW, THEREFORE, BE IT RESOLVED THAT:
SECTION I
The City Council hereby finds that GPA 97-01 should be
and hereby is approved for the following reasons:
1. The proposal is consistent with the intent of the goals
and policies of the General Plan document.
2. The proposed designations will allow the land to be
developed with a first class 18-hole public golf course,
providing recreational and employment opportunities to
Gilroy residents, as well as helping to meet the demand
for golfing facilities in this area.
3. The proposed designations will allow the land to be
developed with a visitor serving recreational use that
will advance Gilroy's appeal as a regional destination,
and thereby spur further economic development within the
City.
4. The City Council has taken all actions required by CEQA.
5. The approval of GPA 97-01 is in the public interest.
SECTION II
The City's General Plan shall be amended to include the
following land use designations and to specify that such land
shall be included within Gilroy's 20-year Area Boundary, which

designations and locations are more particularly described in
Exhibit "A":
1) Approximately 188.78 acres of Parcel 1 of the project
property shall be designated as Park/Public Facility, to
be used for the development of a golf course and
appurtenant facilities.
2) The remainder of Parcel I, approximately 30 acres of land
in the northeastern portion of the project site, shall be
designated Open Space.
3) Two parcels shall be designated Low Density Residential.
Parcel 3 includes approximately 5.65 acres. Parcel 4
includes approximately 8.3 acres.
4) Parcel 2, including approximately 32.69 acres in the
southeast portion of the project, shall be designated
Hillside Residential.
PASSED AND ADOPTED this 4th day of August, 1997 by the
following vote:
AYES: COUNCILMEMBERS: MORALES, ROWLISON, SPRINGER,
VALDEZ, GILROY
NOES: COUNCILMEMBERS: NONE
ABSENT: COUNCILMEMBERS: ROGERS
