RESOLUTION NO. 98-2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING A/S 97-59, AN APPLICATION FOR
ARCHITECTURAL AND SITE APPROVAL, APN 810-30-037
(pARTIAL)
WHEREAS, Albert Fortino ("Applicant") submitted A/S 97-59, an application for
architectural and site approval in order to construct eight (8) single family dwellings on property
totaling 1.19 acres zoned Rl (Low Density Residential), located at the east side of Mesa Road and
backing the west side of Santa Teresa Boulevard, between Nicole Way and Dawn Way; and
WHEREAS, pursuant to the California Environmental Quality Act ("CEQA") the
City Council on October 9, 1997 certified a Negative Declaration with 9 mitigation measures, and a
mitigation monitoring program has been prepared; and
WHEREAS, as a condition of Tentative Map (TM 97-02) approval, the
Architectural and Site Review Application, is subject to review by the Planning Commission and
review and approval by the City Council; and
WHEREAS, the Planning Commission reviewed application A/S 97-59 at its duly
noticed meeting on December 4, 1997 and recommended that the City Council approve A/S 97-59
with nine (9) conditions as set forth in the staffreport dated November 25, 1997, which staff report
is attached hereto as Exhibit A and incorporated herein by this reference; and

WHEREAS, the City Council reviewed Application 97-59 and all documents
relating thereto and took oral and written testimony at its duly noticed meeting of December 15,
1997; and
WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which this project approval is based is the office of the
City Clerk;
NOW, THEREFORE, BE IT RESOLVED THAT
A. The City Council hereby finds:
1. The proposed development is consistent with the intent of the goals and
policies of the City's General Plan document;
2. The proposed Architectural and Site Review Application is consistent with
the Zoning Ordinance;
3. The proposed Architectural and site Review Application is consistent with
the Guidelines for Sound Attenuation and Visual Preservation of the Santa Teresa
Boulevard Corridor; and
4. There is no substantial evidence that the project as mitigated may have a
significant effect on the environment.
B. A/S 97-59 should be and hereby is approved subject to the nine (9) conditions set
forth in the staff report attached hereto as Exhibit A.

Santa Teresa. Boulevard camelor is directly adjacent to the projec~s east property boundary. Existing single
fiunily residential UDits are located to the west. across from Mesa Road, as well as to the south. Agricultural
uses are lol;8Eed further to the east.
As a condition of Tentative Map (TM 97-02) approval. the Architectural and Site Review Application i$: _
subject to review by the Plarming Commission and review and approval by the City Council. The intent of ~
condition is to e:oable Planning Commission and City Council review oflbis project for its continuity with the
existing Mesa Ranch neighborhood.
'lbe proPOSe4 single family dwellings will be developed on lots ranging from 6,248= to 6,918:l: square feet
Pr.oposed lots arc configured sidc-by-side, all along the east side of Mesa Road., and will follow the p8ttem
established with the four previously-constructeci lots to the south. The applicant proposes to wid&:ll and
improve Mesa Road along 1be entire project frontage (including remainder area). Off-site improvernen~ will
be,provided by the applicant, in accordance with City standards, and include the construction of street, curb,
gutter, sidewalk (with landscaped strip), and elearoliers. -
This request is part of a larger proposed development which will ultimately consist of 22 dwelling units on the
3.22-acre project site. The Rl zoning district allows a maximum density of 7.25 units per net acre. Buildout
of the 22 units will establish a density of 6. 83:1:: units per net acre. Therefar~ developme:nt of the project site
will not exceed the maximum allowable density for the R1 zamng district
HOME DESIGN
The applicant intands to develop the 8 individual lots utilizing six distinct plans (see the attached elevation
plans). As submitted, all six plans are designed with two-car garages, stuccoed siding and chimney columns,
and composition roof shingles. These homes will be detailed along the front elevation with decorative
windows, wood or protruding stucco trim, decorative attic vents, and wooden sectional garage doors. Privacy
fences and landscaping are also proposed. The' six proposed plans are further described as fonows:

Boulevard at Lot 22. The barrier height is in reference to the nearest building pad elevation. The design
of the barrier shall be submitted. for the review and approval of the Gilroy Building Division and the Gilroy
Planning Division prior to the approval of the Final Subdivision Map.
To reduce flanking noise, the developer shall construa a minimum 3-foot high acoustically-effective barrier
along the south property line of Lot 1. This barrier may also be the north property barrier recommended
in a previous acoustic:a1 study for the four existing residential lots to 1he south of the proJect site. The
barrier height is in reference to the nearest building pad elevation. The design of the barrier shall be
submitted for the review and approval' of the Gilroy Building Division and the Gilroy Planning Division
prior to the approval of the Final Subdivision Map.
