RESOLUTION NO. 98-16
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY MAKING
CERTAIN FINDINGS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT IN CONNECTION WITH A PROJECT CONSISTING OF A
GENERAL PLAN AND ZONING AMENDMENTS TO CHANGE THE LAND USE
DESIGNATION FROM OPEN SPACE TO GENERAL INDUSTRIAL AND PUBLIC
FACILITY (GPA 97-02 AND Z 97-04)
WHEREAS, the Council Council intends to approve General Plan and Zoning
amendments to change the Land Use designation from Open Space on an approximately
64.54 acre parcel (APN 841-15-074) to General Industrial on 28.04 acres and to Public
Facility on 36.5 acres at the request of applicant Sooners Hospitals for Children, herein
referred to as the "project"; and
WHEREAS, the California Environmental Quality Act (CEQA) requires that, in
the approval of a project for which an Environmental Impact Report (EIR) has been
prepared, the decision-making body shall review the EIR and make certain findings
regarding the significant effects on the environment identified in the EIR; and
WHEREAS, a project to change the entire site from Open Space to General
Industrial was the subject of a Final EIR, consisting of a Draft EIR and a First
Amendment to the EIR dated August 28, 1996, prepared in compliance with CEQA and
certified as complete thereunder by the City Council on October 28, 1996; and
WHEREAS, the City Council on February 17, 1998 approved an Addendum to
the Final EIR dated January 1998, finding it was completed in compliance with CEQA,
that it reflects the independent judgment of the City, and that there are no additional
significant effects due to the change in the project; and
WHEREAS, the City Council of the City of Gilroy is the decision-making body
for General Plan and Zoning amendments; and
WHEREAS, this Council does hereby certify that as a decision-making body, it
has reviewed and considered the information contained in the Final EIR, and other
information in the record, prior to acting upon or approving the project.
NOW THEREFORE, THE COUNCIL DOES HEREBY make the following
findings with respect to the significant effects on the environment of such project as
identified in the Final EIR and Addendum thereto:

LAND USE
#1. ENVIRONMENTAL IMPACT: The proposed project could result in potentially significant land use
impacts including noise, hazardous materials, and construction impacts, as a result oflocating industrial
uses across the street from the Ochoa Migrant Farm worker Housing. (Potentially Significant
Impact)
MITIGATION MEASURE: Conformance with General Plan Economic Development Industrial
Policies 2 and 5, and Industrial Implementation Policy B would avoid or reduce potentially significant
land use impacts to a less-than-significant level. (Less- Than-Significant-Impact with Mitigation)
FINDING: Implementation of the specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.
#2. ENVIRONMENTAL IMPACT: Future industrial development on the site would result in a loss of
open space and would visually alter the existing vacant site by introducing structures and roads onto
the property. (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Community Design and Appearance
Policies 18, 19, and 20; Economic Development Industrial Policies 2 and 5; and Industrial
Implementation Policy B would help to reduce this impact but the project would still result in a
significant unavoidable impact. (Significant Unavoidable Impact)
OVERRIDING CONSIDERATIONS: First, the proposed project will add approximately 28 acres
of land to the City's diminishing industrial land inventory, and 36 acres of Public Facility land. Second,
the development of the industrial land will occur in an area where municipal services are immediately
available, therefore requiring a minimal amount of future public service upkeep. Third, the
development of the industrial land will contribute to the City's job base. Fourth, the development of
the industrial land will contribute the City's tax base. Fifth, the addition of this industrial land is
contiguous to existing industrial lands within the City and represents a consistent pattern that avoids
adjacent land use conflicts. The benefits of allowing the future development of combined Industrial
and Public Facility uses on this site are found to outweigh the significant unavoidable impact from the
loss of open space,
#3. ENVIRONMENTAL IMPACT: The proposed project would result in prime agricultural lands being
converted to non-agricultural use. (Potentially Significant Impact)
MITIGATION MEASURE: There is no mitigation available to reduce or avoid this impact which
would be compatible with the project goals. (Significant Unavoidable Impact)

OVERRIDING CONSIDERATIONS: First, the proposed project will add approximately 28 acres
of land to the City's diminishing industrial land inventory, and 36 acres of Public Facility land. Second,
the development of the industrial land will occur in an area where municipal services are immediately
available, therefore requiring a minimal amount of future public service upkeep. Third, the
development ofthe industrial land will contribute to the City's job base, Fourth, the development of
the industrial land will contribute the City's tax base, Fifth, the addition of this industrial land is
contiguous to existing industrial lands within the City and represents a consistent pattern that avoids
adjacent land use conflicts. The benefits of allowing the future development of combined Industrial
and Public Facility uses on this site are found to outweigh the significant unavoidable impact from the
loss of prime agricultural lands,
SOILS and GEOLOGY
#4. ENVIRONMENTAL IMPACT: Future development would be exposed to seismic hazards
associated with seismic ground shaking typical of the Santa Clara Valley, (Potentially Significant
Impact)
MITIGA TION MEASURE: Conformance with General Plan Public Safety and Seismic Safety
Policy 11 and 14 would avoid or reduce potential hazards to a less-than-significant level. In addition,
conformance with City Building Codes as recommended by project geologic reports will ensure that
impacts are reduced to an insignificant level. (Less- Than-Significant-Impact with Mitigation)
FINDING: Implementation ofthe specific General Plan policies identified above, and within the Final
EIR, will reduce this potential land use impact to a less-than-significant-Ievel.
HYDROLOGY
#5. ENVIRONMENTAL IMPACT: The project is proposed on a site within the 100 year floodplain,
where significant flooding impacts are likely to occur. (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with Public Safety and Seismic Safety Policies 25, 28,
and 29 - (Flooding, Drainage, and Runoff), the Gilroy Floodplain Management Ordinance, including
completion of a project-level flooding study to determine appropriate building layout and blockages,
would ensure that future development would not result in a significant impact. (Less- Than-
Significant-Impact with Mitigation)
FINDING: Implementation of the specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.

#6. ENVIRONMENTAL IMPACT: Future development on the site would increase impervious surfaces
on the site, thereby increasing storm water runoff (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with Public Safety and Seismic Safety Policies 25, 28,
and 29 - (Flooding, Drainage, and Runoff) and completion of a project-level hydrology study to
determine appropriate on-and off-site improvements to the storm drainage system, would ensure that
future development would not result in a significant impact. (Less-Than-Significant-Impact with
Mitigation)
FINDING: Implementation of the specific General Plan policies identified above, and within the Final
EIR, will reduce this potential land use impact to a less-than-significant-Ievel.
#7. ENVIRONMENTAL IMPACT: Project grading and construction activities would temporarily affect
the water quality of the surface runoff by increasing debris, loose soil and potential contamination,
Long-term effects on the water quality ofthe surface runoff would occur with the future installation
of paved streets and parking areas and could potentially affect the water quality in adjacent waterways.
(Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Public Safety and Seismic Safety
Policies 28 and 29 - (Flooding, Drainage, and Runoff) would reduce water quality impacts. In
addition, the applicant would comply with the City Grading Ordinance and with NPDES General
Permit guidelines for avoiding water quality impacts to surface runoff, (Less- Than-Significant
Impact with Mitigation)
FINDING: Implementation ofthe specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.
AIR QUALITY
#8. ENVIRONMENTAL IMPACT: Temporary air quality impacts would occur during construction,
as a result of clearing, grading, and surface preparation and hauling at the site, (Temporary
Significant Impact)
MITIGA TION MEASURE: Conformance with the City Grading Ordinance and the Mitigation
Measures to be Considered at the Time of Future Development in the Air Quality Section of this EIR
at the time of development of future uses on the site would ensure that short -term construction impacts
are avoided or reduced to less-than-significant impacts, (Less- Than-Significant-Impact with
Mitigation)
FINDING: Implementation ofthe specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.

TRANSPORTATION / CIRCULATION
#9. ENVIRONMENTAL IMPACT: Traffic from the development ofthe proposed future uses on the
site will contribute to peak hour traffic congestion, (Potentially Significant Impact)
MITIGATION MEASURE: Development of the project would result in significant traffic impacts.
Conformance with General Plan Transportation Policies 8, 9, and 10 will help reduce transportation
impacts, but the project may still cause significant congestion on local and regional roadways.
Mitigation Measures to be Considered at the Time of Future Development are identified in the
Transportation/Circulation Section of the EIR, which if implemented at the time of development of
future uses on the site would help to reduce this impact, but the project would still potentially result
in a significant unavoidable impact, (Significant Unavoidable Impact)
OVERRIDING CONSIDERATIONS: First, the proposed project will add approximately 28 acres

implementing the General Plan Circulation Element, The alignment through the site would determine
the plan line of Eastside Boulevard and could impact adjacent properties. (Potentially Significant
Impact)
MITIGATION MEASURE: Conformance with General Plan Transportation Policy 2, and
implementation of Mitigation Measures to be Considered at the Time of Future Development identified
in the Transportation/Circulation Section of the EIR at the time of development of future uses on the
site would ensure that traffic/circulation impacts are avoided or reduced to a less-than-significant level.
(Less-Than-Significant-Impact with Mitigation)

#11 ENVIRONMENTAL IMPACT: The proposed project would add incrementally to existing noise
levels from traffic in the area, Traffic levels on adjacent streets, including Southside Drive, Rossi Lane,
and Luchessa Road would increase significantly beyond existing levels. (Potentially Significant
Impact)
MITIGATION MEASURE: Conformance with General Plan Noise Policies 31, 32, 33, 35, 36, and
37, and implementation of the Mitigation Measures to be Considered at the Time of Future
Development identified in the Noise Section of this EIR at the time of development of future uses on
the site would ensure that noise impacts are avoided or reduced to a less-than-significant level. (Less-
Than-Significant-Impact with Mitigation)
FINDING: Implementation ofthe specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.
#12 ENVIRONMENTAL IMPACT: Future development of industrial uses on the project site could
result in noise impacts to the Ochoa Migrant farm worker housing, both from traffic on Southside
Drive and Rossi Lane and from future industrial activities. (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Noise Policy 33, and implementation
of the Mitigation Measures to be Considered at the Time of Future Development identified in the
Noise Section of the EIR at the time of development of future uses on the site would ensure that noise
impacts are avoided or reduced to a less-than-significant level. (Less- Than-Significant-Impact with
Mitigation)
FINDING: Implementation ofthe specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.
#13 ENVmONMENTAL IMPACT: Construction of future development would temporarily increase
noise levels in the project area and would result in significant noise impacts to the Ochoa Migrant farm
worker housing. (Significant Temporary Impact)
MITIGATION MEASURE: Conformance with the City Zoning Ordinance at the time of
development of future uses on the site would ensure that short-term noise impacts are avoided or
reduced to less-than-significant impacts. (Less- Than-Significant Impact with Mitigation)
FINDING: Implementation of the Zoning Ordinance identified above, and within the Final EIR, will
reduce these potential land use impacts to a less-than-significant-Ievel.

#14. ENVIRONMENTAL IMPACT: Development of future industrial uses on the project site would
generate an increased demand on water, storm drainage, electrical, telephone, and sewage treatment
and sanitary sewer systems. (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Sanitary Sewer Facilities Policies 26,
27, and 28; Water Facilities Policies 30, 31, 32, 33, and 34; and Public Safety and Seismic Safety
Policies 25, 28, and 29 - (Flooding, Drainage, and Runoff) and completion of a project-level
hydrology study to determine appropriate on-and off-site improvements to the storm drainage system,
would ensure that impacts to these utility systems would be avoided or reduced to a less-than-
significant level. (Less- Than-Significant Impact With Mitigation)
FINDING: Implementation of the specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.
CUMULATIVE IMPACTS
#15 ENVIRONMENTAL IMPACT: The future development of the project site, in conjunction with the
development of "reasonably foreseeable projects" would result in a loss of open space and would
visually alter the existing vacant site by introducing structures and roads onto the property.
(Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Community Design and Appearance

development and recently proposed General Plan Amendments will contribute to both long-term and
short-term regional air quality problems. (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Air Quality Policies 21, 22, 24, 29,
and 30, and Air Quality Mitigation Program for New Development Policy W would help reduce air
quality impacts. There is no mitigation measure that would reduce regional air quality impacts to a less
than significant level. (Significant Unavoidable Impact)
OVERRIDING CONSIDERATIONS: First, the proposed project will add approximately 28 acres
of land to the City's diminishing industrial land inventory, and 36 acres of Public Facility land. Second,
the development of the industrial land will occur in an area where municipal services are immediately
available, therefore requiring a minimal amount of future public service upkeep. Third, the
development ofthe industrial land will contribute to the City's job base, Fourth, the development of
the industrial land will contribute the City's tax base. Fifth, the addition of this industrial land is

10, and the Mitigation Measures to be Considered at the Time of Future Development would ensure
that traffic/circulation impacts are avoided or reduced to a less-than-significant level. (Less- Than-
Significant-Level)

EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.
#19. ENVIRONMENTAL IMPACT: Future development on the project site, in conjunction with the
development of "reasonably foreseeable projects" would contribute incrementally to cumulative noise
increases within the City. (Potentially Significant Impact)
MITIGATION MEASURE: Conformance with General Plan Noise Policies 31, 32, 33, 35, 36 and
37 would ensure that noise impacts are avoided or reduced to a less-than-significant level. (Less-
Than-Significant-Impact with Mitigation)
FINDING: Implementation ofthe specific General Plan policies identified above, and within the Final
EIR, will reduce these potential land use impacts to a less-than-significant-Ievel.

ADOPTION OF MITIGATION MEASURES AND MITIGATION/MONITORING
The City Council hereby adopts the mitigation measures as set forth in the Final EIR, and
the Mitigation and Monitoring Program as set forth in the Final EIR and attached hereto
as Exhibit A.
ALTERNATIVES TO THE PROJECT
No Project (No Development)
The no project alternative consists of leaving the site in its present condition. This
alternative would avoid all of the environmental impacts of the project.
FINDING: This alternative is rejected because it is not considered to be economically
feasible, does not meet the project objectives, and does not bring any new jobs or
increased revenues to the City.
No Project (Development Under Existing General Plan and Zoning Designations)
This alternativ~ would leave the site with its current land use designation of Open Space.
Uses allowed under this designation include agricultural, conservation and wildlife
sanctuaries, communication and public utility facilities, guest ranches and recreational
uses. As analyzed in the EIR, development of these uses would generally result in fewer
and less intense impacts than the proposed project.
FINDING: Many of the allowed uses are not feasible in this location due to the
encroachment of the Wastewater Treatment Plant and the adjacent industrial area. The
"No Project-Development Under the Existing General Plan Designation" alternative is
rejected because it does not meet any of the identified project objectives.
Reduced Scale Scenario. The analysis for the EIR was based on an assumed project
buildout coverage of 44 percent across 64.54 acres. An alternative analyzed a project
reduced to 35 percent coverage, and concluded that reduced impacts would occur.
However, the revision to the project from designating all 64.54 acres as general industrial
to designating approximately 28 acres to general industrial achieves the reduction in
impacts associated with the reduced scale scenario.
FINDING: This alternative is acceptable, and in fact is substantially similar to the
currently proposed project. The current project is environmentally superior both to the
originally proposed project and the reduced scale alternative analyzed in the EIR.
Expansion of the Wastewater Treatment Plant and Ponds. This alternative would
expand Treatment Plant capacity for ponding and percolation. As discussed in detail in
the EIR, it would result in less traffic impacts, less noise and air quality impacts, a
significant decrease in potential for soils and geology impacts and in hydrological
impacts, and in a significant decrease in the demand for utilities. However, use of the site
in this manner could still potentially impact the Ochoa Migrant Farmworker Housing

located to the northeast of the project site due to odor generated by these facilities. In
addition, such development would result in the loss of prime agricultural land.
FINDING: This alternative is the environmentally superior alternative when compared to
the proposed project. However, this alternative is rejected because it is not compatible
with the project objectives in the short-term.
STATEMENT OF OVERRIDING CONSIDERATIONS
After review of the entire administrative record, including the Final EIR, the staff
report, and the oral and written testimony and evidence presented at public hearings, the
City Council finds that specific economic, legal, social, technological and other
considerations justify the approval of this project in spite of the existence of unavoidable
environmental effects that are deemed significant and that cannot be completely mitigated
to a level of insignificance.
The City Council adopts and makes a Statement of Overriding Considerations
regarding the significant unavoidable impacts of the project and the anticipated benefits
of the project as set forth in Findings #2 and #3 regarding project Land Use impacts from
loss of open space and conversion of prime agricultural land; Finding #9 regarding
Transportation/Circulation impacts from local and regional roadways; and Findings 15,
16 and 17 regarding Cumulative impacts from loss of open space, conversion of prime
agricultural land and regional air quality.
The City Council finds that each of the benefits set forth in the Statement
constitutes a separate and independent ground for finding that the benefits of the project
outweigh the risks of its potential significant adverse environmental impacts.
