RESOLUTION NO, 98-46
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING A GENERAL PLAN AMENDMENT TO
SECTION VI" PUBLIC SERVICES AND FACILITIES,
ALLOWING THE DEDICATION OF LAND AND/OR PAYMENT
OF FEES IN LIEU OF DEDICATION BY DEVELOPERS OF NEW
RESIDENTIAL SUBDIVISIONS, TO BE USED FOR CULTURAL
FACILITIES, GP A 98-0 I
WHEREAS, the City of Gilroy General Plan presently requires developers of new
residential subdivisions to dedicate land and/or pay fees in lieu ofland dedication for the acquisition and
development of recreational facilities; and
WHEREAS, the City of Gilroy believes it to be in the public interest to facilitate the
cultural and artistic needs of all individuals in Gilroy; and
WHEREAS, this amendment has been reviewed and recommended for approval by the
following advisory boards and commissions:
Parks & Recreation and Community Facilities Subcommittee of the General Plan
Update Committee; Parks & Recreation System Master Plan Task Force, General Plan
Update Committee (GPUC), City of Gilroy Parks & Recreation Commission; City of
Gilroy Arts and Cultural Commission; and
WHEREAS, the City Council held a duly noticed public hearing on GP A 98-01 on
August 3, 1998, at which time the City Council considered the amendment, public testimony, the Staff
Report dated July 22, 1998, and all other documentation on the proposal,
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council hereby finds that GP A 98-01 should be and hereby is approved for the
following reasons:
1, The proposal is consistent with the intent of the over-all goals and policies of the
General Plan,

2, The proposed text amendment will help to facilitate and recognize the cultural and
artistic aspirations of all individuals in the City of Gilroy;
3, The proposed text amendment will maximize potential options available to the City
Council for implementation of the City's General Plan; and
4, The approval ofGPA 98-01 is in the public interest.
B, GP A 98-01 should be and hereby is approved as follows:
1. The City of Gilroy General Plan, Section VI, Public Services and Facilities, at Page
VI-I, following the paragraph beginning with the words "A basic goal" and ending
with the words "increased demand":
The City of Gilroy recognizes the cultural and artistic aspirations of all individuals in
Gilroy. To achieve this goal, the City should provide parks and recreational facilities and
programs, which may include cultural facilities and programs as set forth in the Gilroy
Cultural Plan (1997) and Cultural Facilities Needs Analysis (1998).
2, The City of Gilroy General Plan, Section VI Public Services and Facilities, at Page
VI-4, Paragraph 11, is revised to read as follows:
Developers of new residential subdivisions will be required to dedicate land and/or pay fees in
lieu of dedication for the acquisition and development of recreational facilities, which may

include cultural facilities, which will serve the subdivision, neighborhood and community.
